  1.1                          A bill for an act 
  1.2             relating to education; authorizing school districts 
  1.3             with care and treatment facilities to bill resident 
  1.4             school district of students in care and treatment 
  1.5             facilities; amending Minnesota Statutes 2002, section 
  1.6             125A.515, by adding a subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 125A.515, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 9a.  [NONREIMBURSED EDUCATION SERVICES.] A school 
  1.11  district that has a care and treatment facility within its 
  1.12  boundaries and has students that are not allowed to leave the 
  1.13  premises may bill all expenses that are not reimbursed by aid to 
  1.14  the district of residence and hold the providing district 
  1.15  fiscally harmless for direct and indirect expenses for providing 
  1.16  education to these students.  The expenses may include lease and 
  1.17  rent costs and designated administrative costs that are not 
  1.18  determined by kindergarten through grade 12 formulas.  The 
  1.19  department shall determine allowable expenses if contested by a 
  1.20  resident district. 
  1.21     [EFFECTIVE DATE.] This section is effective for the 
  1.22  2004-2005 school year and later.
