relating to environment; requiring review prior to construction of a new school
building on a landfill site; proposing coding for new law in Minnesota Statutes,
chapter 115B.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Construction of a new school building on a permitted or unpermitted landfill site may
not begin unless the commissioner of the Pollution Control Agency has conducted a review
and determined any restrictions, conditions, or controls on the use of the real property. A
school building may not be constructed on a permitted or unpermitted landfill site that the
commissioner has deemed is unsuitable for use as a location for school buildings.
