  1.2             relating to local government; the cities of Norwood 
  1.3             and Young America in Carver county and their 
  1.4             consolidation into the city of Norwood-Young America; 
  1.5             repealing Extra Session Laws 1857, chapter 18, section 
  1.6             50; Special Laws 1874, chapter 78; Special Laws 1879, 
  1.7             chapters 4 and 152; Special Laws 1881, chapters 31 and 
  1.8             101; Special Laws 1889, chapter 24; and Special Laws 
  1.9             1891, chapters 211 and 272. 
  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  [MERGER OF THE CITIES OF NORWOOD AND YOUNG 
  1.12  AMERICA.] 
  1.13     Subdivision 1.  [INTENT; TIME OF MERGER.] The cities of 
  1.14  Norwood and Young America in Carver county have conducted the 
  1.15  necessary proceedings to combine as one municipality effective 
  1.16  January 1, 1997, to be known as Norwood-Young America all 
  1.17  pursuant to Minnesota Statutes, sections 465.81 to 465.87.  It 
  1.18  is the intent of this act to facilitate the combination and 
  1.19  merger of the cities in accordance with the plan.  The cities 
  1.20  are merged on the effective date. 
  1.21     Subd. 2.  [DEFINITIONS.] For purposes of this act, the term 
  1.22  "plan" means the plan for merger and implementation adopted by 
  1.23  the cities of Norwood and Young America on November 11 and 12, 
  1.24  1995, and approved by the board of government innovation and 
  1.25  cooperation.  The term "effective date" means 12:01 a.m. on 
  1.26  January 1, 1997. 
  1.27     Sec. 2.  [APPLICATION OF LAW.] 
  2.1      On the effective date, the city of Norwood-Young America 
  2.2   will be governed by the laws generally applicable to statutory 
  2.3   cities operating under optional plan A except as specifically 
  2.4   provided otherwise in this act. 
  2.5      Sec. 3.  [GOVERNING BODY; ELECTIONS; TRANSITION; WARDS.] 
  2.6      Subdivision 1.  [COUNCIL.] On and after the effective date, 
  2.7   the city of Norwood-Young America is to be governed by a city 
  2.8   council composed of a mayor and four council members elected in 
  2.9   the manner, from the wards, at the times, and for the terms set 
  2.10  forth in this section. 
  2.11     Subd. 2.  [ELECTIONS.] The regular municipal election for 
  2.12  the cities of Norwood and Young America, respectively, are not 
  2.13  to be held in November 1996.  A regular municipal election for 
  2.14  the city of Norwood-Young America is to be held on the regular 
  2.15  municipal election day in November 1996.  For the purposes of 
  2.16  Minnesota election law, the city clerk jointly designated by the 
  2.17  cities of Norwood and Young America prior to July 1, 1996, is 
  2.18  the local election official for the municipal election in 1996.  
  2.19  At that election and subsequent elections, officers are to be 
  2.20  elected for the city of Norwood-Young America for the terms and 
  2.21  in the years described in the following table:

  3.1      Subd. 3.  [WARDS.] For purposes of the municipal elections 
  3.2   in 1996 and 1998, the city of Norwood-Young America is divided 
  3.3   into two wards.  Ward 1 consists of the territory in the city of 
  3.4   Norwood on December 31, 1996, and ward 2 consists of the 
  3.5   territory in the city of Young America on December 31, 1996.  
  3.6   The wards will terminate on December 31, 1999. 
  3.7      Subd. 4.  [TERMS OF INCUMBENTS.] The terms of office of the 
  3.8   elected officers of the cities of Norwood and Young America in 
  3.9   office on December 31, 1996, terminate at 12:00 midnight at the 
  3.10  end of that date. 
  3.11     Sec. 4.  [ORDINANCES; LICENSES; LOANS.] 
  3.12     Subdivision 1.  [ORDINANCES.] The ordinances of the cities 
  3.13  of Norwood and Young America in effect on December 31, 1996, 
  3.14  continue in effect within the boundaries of the former cities 
  3.15  until repealed by the city council of Norwood-Young America, but 
  3.16  those ordinances must be enforced in the name of Norwood-Young 
  3.17  America. 
  3.18     Subd. 2.  [LICENSES.] The combined number of license 
  3.19  privileges existing pursuant to law in the cities of Norwood and 
  3.20  Young America on December 31, 1996, is the same number that will 
  3.21  exist in Norwood-Young America on the effective date. 
  3.22     Sec. 5.  [PUBLIC FACILITIES AUTHORITY LOAN.] 
  3.23     The city of Norwood may apply for and continue to process 
  3.24  an application for a loan from the public facilities authority 
  3.25  for the expansion of the city of Norwood wastewater treatment 
  3.26  facility.  The public facilities authority is authorized and 
  3.27  directed to evaluate and analyze the loan application as if it 
  3.28  were being made by the city of Norwood-Young America after the 
  3.29  effective date.  Notwithstanding Minnesota Statutes, section 
  3.30  465.86, after the effective date the city of Norwood-Young 
  3.31  America is required to make debt service payments and tax 
  3.32  levies, if any, for the note or bond obligation, if any, 
  3.33  representing the public facilities authority loan issued by the 
  3.34  city of Norwood prior to the effective date. 
  3.35     Sec. 6.  [REPEALER.] 
  3.36     Extra Session Laws 1857, chapter 18, section 50; Special 
  4.1   Laws 1874, chapter 78; Special Laws 1879, chapters 4 and 152; 
  4.2   Special Laws 1881, chapters 31 and 101; Special Laws 1889, 
  4.3   chapter 24; and Special Laws 1891, chapters 211 and 272, are 
  4.4   repealed. 
  4.5      Sec. 7.  [LOCAL APPROVAL.] 
  4.6      This act takes effect at 12:01 a.m. the day after the 
  4.7   latter of the governing bodies of the cities of Norwood and 
  4.8   Young America complies with Minnesota Statutes, section 645.021, 
  4.9   subdivision 3.
