A bill for an act
relating to agricultural data; classifying agricultural research data maintained by
the University of Minnesota; amending Minnesota Statutes 2016, section 13.643,
by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2016, section 13.643, is amended by adding a subdivision
to read:

new text begin Agricultural informatics platform data. new text end

new text begin (a) For purposes of this subdivision,
"agricultural informatics platform data" means data supplied to or collected, created, received,
or maintained by the University of Minnesota for inclusion on an agricultural informatics
platform or any similar agricultural research database maintained by or hosted at the
University of Minnesota.

new text begin (b) Agricultural informatics platform data are classified as private data on individuals
or nonpublic data, but may be released to:

new text begin (1) researchers employed by the University of Minnesota; or
new text end

new text begin (2) other researchers authorized by the University of Minnesota to receive the data,
provided that the person who supplied the agricultural informatics platform data has
consented to the release of the data.

new text begin (c) Nothing in this subdivision prohibits the disclosure of private data with the informed
consent of the data subject pursuant to section 13.05, subdivision 4, or the preparation of
summary data as defined in section 13.02, subdivision 19.
