  1.1                          A bill for an act 
  1.2             relating to human services; appropriating money for 
  1.3             grants to counties for children's mental health 
  1.4             services. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [APPROPRIATION.] 
  1.7      Subdivision 1.  [CHILDREN'S MENTAL HEALTH SERVICES.] 
  1.8   $2,000,000 is appropriated from the general fund to the 
  1.9   commissioner of human services for the purpose of awarding 
  1.10  grants to counties for children's mental health services. 
  1.11     Subd. 2.  [INDIVIDUAL FAMILY COMMUNITY SUPPORT PLAN.] Funds 
  1.12  shall be used to provide services according to an individual 
  1.13  family community support plan as described in Minnesota 
  1.14  Statutes, section 245.4881, subdivision 4.  The plan must be 
  1.15  developed using a process that enhances consumer empowerment.  
  1.16  Counties that have approved children's mental health 
  1.17  collaboratives may integrate funds appropriated beginning July 
  1.18  1, 1997, with existing funds to meet the needs of the child and 
  1.19  family as identified in the child's individual family community 
  1.20  support plan. 
  1.21     Subd. 3.  [PROCESS FOR AWARDING GRANTS.] In awarding grants 
  1.22  to counties, the commissioner shall follow the process 
  1.23  established in Minnesota Statutes, section 245.4886, subdivision 
  1.24  2.  The commissioner shall give priority for funding to counties 
  1.25  that continued to spend for mental health services specified in 
  2.1   Minnesota Statutes, sections 245.461 to 245.486 and 245.487 to 
  2.2   245.4888, according to generally accepted accounting principles, 
  2.3   in an amount equal to the total expenditures shown in the 
  2.4   county's approved 1987 Community Social Service Act plan for 
  2.5   services to persons with mental illness plus the comparable 
  2.6   figure for facilities licensed under Minnesota Rules, chapter 
  2.7   9545, for target populations other than mental illness in the 
  2.8   approved 1989 Community Social Service Act plan.  The 
  2.9   commissioner shall ensure that grant funds are not used to 
  2.10  replace existing funds.
