A bill for an act
relating to arts; modifying membership of Minnesota State Arts Board;
appropriating money for American descendants of slavery; amending Minnesota
Statutes 2020, section 129D.02, subdivision 1.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 129D.02, subdivision 1, is amended to read:


Subdivision 1.

Membership.

The Board of the Arts deleted text begin shall consistdeleted text end new text begin consistsnew text end of 11 members
to be appointed by the governor with the advice and consent of the senate. One member
deleted text begin shalldeleted text end new text begin mustnew text end be appointed from each of the congressional districts, and the remaining members

experience or interest in the artsnew text begin , and no less than three of the members serving at any time
must be American descendants of slavery

appointment have received or applied for, in the member's name, a grant, loan or other form
of assistance from the board or its predecessor, the State Arts Council. No more than four
of the members shall during their terms of office be officers, directors or employees of

this section, "American descendants of slavery" means people who are descended from
Africans who were enslaved specifically in the United States from the colonial period

Sec. 2. new text begin APPROPRIATION; ARTS FUNDING FOR DESCENDANTS OF SLAVERY.

new text begin $8,000,000 in fiscal year 2022 and $8,000,000 in fiscal year 2023 are appropriated from
the arts and cultural heritage fund to the Minnesota State Arts Board for grants to
organizations and individuals who are American descendants of slavery. For the purposes
of this section, "American descendants of slavery" means people who are descended from
Africans who were enslaved specifically in the United States from the colonial period
onward. The arts board must develop criteria for determining eligible grantees in consultation
with members of the community who are experts in the African slave experience and with
the Council for Minnesotans of African Heritage.
