A bill for an act
relating to state government; requiring the Legislative Advisory Commission to
approve a beneficiary mitigation plan or amendment before the Pollution Control
Agency submits the plan or amendment to the Volkswagen Settlement trustee.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

BENEFICIARY MITIGATION PLANS AND AMENDMENTS.

new text begin The Pollution Control Agency shall not submit to the trustee any beneficiary mitigation
plan, or any amendment to a plan, until the Pollution Control Agency has submitted the
plan or amendment to the Legislative Advisory Commission and the commission has
affirmatively approved the plan or amendment. The Legislative Advisory Commission shall
approve a plan or amendment only if it finds that the plan or amendment is in the best
interests of the people of Minnesota and conforms to the requirements of the Volkswagen
Settlement. For purposes of this section, the term "trustee" means the trustee appointed to
administer the Environmental Mitigation Trust Agreement for State Beneficiaries described
in Attachment A to the United States' Notice of Filing of Trust Agreements in the case of
United States v. Volkswagen AG et al., Case No. 16-cv-295 (N.D. Cal.).
