  1.1                          A bill for an act
  1.2             relating to the environment; delaying the effective 
  1.3             date for certain used motor oil and motor oil filter 
  1.4             provisions; requiring a plan for collection and 
  1.5             recycling of used motor oil and used motor oil 
  1.6             filters; amending Laws 1995, chapter 220, section 142. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Laws 1995, chapter 220, section 142, is amended 
  1.9   to read: 
  1.10     Sec. 142.  [EFFECTIVE DATES.] 
  1.11     Sections 2, 5, 7, 20, 42, 44 to 49, 56, 57, 101, 102, 117, 
  1.12  and 141, paragraph (d), are effective the day following final 
  1.13  enactment. 
  1.14     Sections 114, 115, 118, and 121 are effective January 1, 
  1.15  1996. 
  1.16     Sections 119, 120, subdivisions 2, 3, 4, and 5, and 141, 
  1.17  paragraph (c), are effective July 1, 1996. 
  1.18     Section 141, paragraph (b), is effective June 30, 1999. 
  1.19     Section 119 is effective September 1, 1996. 
  1.20     Section 120, subdivision 1, is effective July 1, 1999. 
  1.21     Sec. 2.  [PLAN.] 
  1.22     (a) By September 1, 1996, an industry group representing 
  1.23  retailers and manufacturers that sell motor oil and motor oil 
  1.24  filters shall submit a list to the commissioner of the pollution 
  1.25  control agency of all existing current sites that collect used 
  1.26  motor oil, used motor oil filters, or both, from the public, 
  2.1   delineating which sites collect for free, that can be publicly 
  2.2   promoted. 
  2.3      (b) By September 1, 1996, an industry group representing 
  2.4   retailers and manufacturers that sell motor oil and motor oil 
  2.5   filters shall submit to the commissioner of the pollution 
  2.6   control agency a plan for a collection and recycling system for 
  2.7   used motor oil and used motor oil filters generated by the 
  2.8   public under which: 
  2.9      (1) at least 90 percent of state residents outside the 
  2.10  seven-county metropolitan area would have access to a free 
  2.11  collection site for used motor oil and used motor oil filters 
  2.12  within 25 miles of their residences; 
  2.13     (2) at least 90 percent of state residents within the 
  2.14  seven-county metropolitan area and state residents of cities 
  2.15  with populations of greater than 2,000 residents would have 
  2.16  access to a free collection site for used motor oil and used 
  2.17  motor oil filters within five miles of their residences; and 
  2.18     (3) at least one free collection site for used motor oil 
  2.19  and used motor oil filters generated by the public would be 
  2.20  located in each county.  
  2.21     (c) The plan required in paragraph (b) must include: 
  2.22     (1) an explanation of the proposed system for collecting 
  2.23  and recycling used motor oil and used motor oil filters; 
  2.24     (2) a clear assignment of responsibility and accountability 
  2.25  for implementation; 
  2.26     (3) a strategy for educating the parties responsible for 
  2.27  implementing the plan; 
  2.28     (4) a strategy for educating the public on how to recycle 
  2.29  used motor oil and used motor oil filters; 
  2.30     (5) a description of government's role, if any; and 
  2.31     (6) recommendations for legislation, if necessary. 
  2.32     (d) The plan must be implemented by June 1, 1997, and the 
  2.33  requirements in paragraph (b), clauses (1) to (3), must be met 
  2.34  by December 31, 1997.  The industry group must also submit a 
  2.35  list of sites that collect used motor oil and used motor oil 
  2.36  filters from the public, specifying those sites that collect 
  3.1   used motor oil and used motor filters for free, to the pollution 
  3.2   control agency by December 31, 1997.  The agency must be 
  3.3   informed by the industry group when sites begin and cease to 
  3.4   collect, or charge for the collection of, used motor oil and 
  3.5   used motor oil filters from the public, in order to allow the 
  3.6   agency to provide the public with accurate information regarding 
  3.7   collection sites. 
  3.8      (e) The industry group and the agency shall monitor the 
  3.9   effects of the collection system set forth in the plan required 
  3.10  in paragraph (b) to determine whether the requirements in 
  3.11  clauses (1) to (3) of that paragraph have been met.  By November 
  3.12  1, 1998, the industry group shall submit information to the 
  3.13  agency on the amount of used oil and the number of used oil 
  3.14  filters collected.  
  3.15     (f) By January 15, 1999, the commissioner of the pollution 
  3.16  control agency shall report to the environment and natural 
  3.17  resources committees of the senate and the house of 
  3.18  representatives on the amount of used motor oil and used motor 
  3.19  oil filters being recycled and whether the requirements in 
  3.20  paragraph (b), clauses (1) to (3), have been met.
