  1.1                          A bill for an act 
  1.2             proposing an amendment to the Minnesota Constitution, 
  1.3             article XIII, section 3; providing for appointment of 
  1.4             members of the University of Minnesota board of 
  1.5             regents; amending Minnesota Statutes 2000, section 
  1.6             137.023; proposing coding for new law in Minnesota 
  1.7             Statutes, chapter 137; repealing Minnesota Statutes 
  1.8             2000, section 137.024. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10                             ARTICLE 1 
  1.11     Section 1.  [CONSTITUTIONAL AMENDMENT PROPOSED.] 
  1.12     An amendment to the Minnesota Constitution is proposed to 
  1.13  the people.  If the amendment is adopted, article XIII, section 
  1.14  3, shall be amended to read: 
  1.15     Sec. 3.  Notwithstanding territorial Laws 1851, chapter 3, 
  1.16  the election and appointment of the board of regents of the 
  1.17  University of Minnesota shall be provided for in a manner 
  1.18  prescribed by law.  Except as provided in this section, all the 
  1.19  rights, immunities, franchises and endowments heretofore granted 
  1.20  or conferred upon the University of Minnesota are perpetuated 
  1.21  unto the university. 
  1.22     Sec. 2.  [SUBMISSION TO VOTERS.] 
  1.23     The proposed amendment shall be submitted to the people at 
  1.24  the 2002 general election.  The question submitted shall be: 
  1.25     "Shall the Minnesota Constitution be amended to require 
  1.26  that the election and appointment of the University of Minnesota 
  1.27  board of regents be provided for in a manner prescribed by law? 
  2.1                                      Yes .......
  2.2                                      No ........" 
  2.3                              ARTICLE 2 
  2.4      Section 1.  [137.0225] [BOARD OF REGENTS.] 
  2.5      Subdivision 1.  [MEMBERSHIP.] The board of regents shall 
  2.6   consist of 12 members to be appointed by the governor with the 
  2.7   advice and consent of the senate.  One member shall be appointed 
  2.8   from each of the congressional districts with remaining members 
  2.9   to be appointed at large and must include a university student 
  2.10  pursuant to section 137.023.  Filling of vacancies on the board 
  2.11  and removal of members are governed by section 15.0575. 
  2.12     Subd. 2.  [TERMS OF OFFICE.] As each member now serving as 
  2.13  of the effective date of this section reaches the end of the 
  2.14  member's term of office, a new member shall be appointed under 
  2.15  this section.  A new member shall be appointed for six years and 
  2.16  each successor thereafter shall be appointed for six years. 
  2.17     Sec. 2.  Minnesota Statutes 2000, section 137.023, is 
  2.18  amended to read: 
  2.19     137.023 [UNIVERSITY STUDENT ON BOARD OF REGENTS.] 
  2.20     In electing members of the board of regents pursuant to 
  2.21  article 13, section 3, of the Constitution of the state of 
  2.22  Minnesota, and Territorial Laws 1851, chapter 3, section 5, One 
  2.23  member of the board of regents of the university shall be a 
  2.24  person who at the time of election to the board is a student who 
  2.25  is enrolled in a degree program at the university.  This person 
  2.26  shall represent the state at large.  Upon expiration of the term 
  2.27  or in the event of a vacancy in the office, one position shall 
  2.28  be filled by a person having the same qualifications. 
  2.29     Sec. 3.  [LEGISLATURE TO AMEND JOINT RULES.] 
  2.30     Upon ratification of the constitutional amendment in 
  2.31  article 1 of this act, the legislature shall meet and amend the 
  2.32  Joint Rules of the senate and house by deleting Article IV of 
  2.33  the Joint Rules, relating to election of regents. 
  2.34     Sec. 4.  [REPEALER.] 
  2.35     Minnesota Statutes 2000, section 137.024, is repealed. 
  2.36     Sec. 5.  [EFFECTIVE DATE.] 
  3.1      This article takes effect the day following adoption of the 
  3.2   constitutional amendment proposed by article 1, except that if 
  3.3   the constitutional amendment proposed in article 1 is not 
  3.4   adopted at the 2002 general election, this article shall not 
  3.5   take effect.
