  1.1                          A bill for an act 
  1.2             relating to human services; eliminating case mix 
  1.3             scores used to assess persons with mental retardation; 
  1.4             providing a rate increase for employees; appropriating 
  1.5             money; repealing Minnesota Statutes 1996, section 
  1.6             256B.501, subdivision 3g. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [ELIMINATION OF CASE MIX SCORES.] 
  1.9      Subdivision 1.  [LEGISLATIVE INTENT.] It is the intent of 
  1.10  the legislature to repeal the unneeded, unused, and costly 
  1.11  requirement that persons with mental retardation be assessed by 
  1.12  case mix scores for the following reasons:  the scores are 
  1.13  incomplete measures of a person's needs, the scores are exempt 
  1.14  from the rate setting process at least to October 1, 1999, and 
  1.15  the department of human services has no plans to use the 
  1.16  instrument in a managed care/capitated payment arrangement.  It 
  1.17  is also the intent of the legislature to capture the savings 
  1.18  from this repeal and reinvest it in wages for persons providing 
  1.19  residential supports to people with developmental disabilities. 
  1.20     Subd. 2.  [RATE INCREASE FOR EMPLOYEES; (WAIVERED SERVICES 
  1.21  AND SEMI-INDEPENDENT LIVING.)] (a) [RATE INCREASE.] Effective 
  1.22  July 1, 1998, the commissioner of human services shall increase 
  1.23  allocation rates by ....... percent for home and community-based 
  1.24  waiver services for persons with mental retardation or related 
  1.25  conditions under Minnesota Statutes, section 256B.501, and 
  1.26  semi-independent living services under Minnesota Statutes, 
  2.1   section 252.275, including SILS funding under county social 
  2.2   services grants formerly funded under Minnesota Statutes, 
  2.3   chapter 256I. 
  2.4      (b) [ICFs/MR.] Effective October 1, 1998, the commissioner 
  2.5   shall increase reimbursement rates, in addition to the inflation 
  2.6   adjustment established in Laws 1997, chapter 203, article 1, 
  2.7   section 1, subdivision 7, designated reimbursement increases by 
  2.8   ....... percent for intermediate care facilities for persons 
  2.9   with mental retardation or related conditions under Minnesota 
  2.10  Statutes, section 256B.501. 
  2.11     (c) [USE OF FUNDS.] The increases provided in this section 
  2.12  shall be used solely for employee wages and costs, including 
  2.13  social security, workers' compensation, Medicare, and 
  2.14  unemployment compensation, that are directly increased by 
  2.15  increases in wages. 
  2.16     (d) [ADJUSTMENT OF RATES.] The commissioner shall adjust 
  2.17  the rates in paragraph (a) and provide the adjusted rates 
  2.18  directly to affected programs. 
  2.19     (e) [MONITORING OF INCREASED EMPLOYEE WAGES.] The host 
  2.20  county shall monitor the application of increased employee wages 
  2.21  specified in paragraph (a) and provide reports as requested by 
  2.22  the commissioner.  The commissioner shall monitor the 
  2.23  application of employee wages specified in paragraph (b). 
  2.24     Sec. 2.  [APPROPRIATION.] 
  2.25     $....... is appropriated to the commissioner of human 
  2.26  services for purposes of section 1. 
  2.27     Sec. 3.  [REPEALER.] 
  2.28     Minnesota Statutes 1996, section 256B.501, subdivision 3g, 
  2.29  is repealed.
