  1.1                          A bill for an act
  1.2             relating to to firearms; providing that a permit to 
  1.3             carry is not required when a pistol is possessed or 
  1.4             transported in a motor home or travel trailer; 
  1.5             amending Minnesota Statutes 1994, section 624.714, 
  1.6             subdivisions 1 and 9.  
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1994, section 624.714, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [PENALTY.] (a) A person, other than a law 
  1.11  enforcement officer who has authority to make arrests other than 
  1.12  citizens arrests, who carries, holds or possesses a pistol in a 
  1.13  motor vehicle other than a motor home, as defined in section 
  1.14  168.011, subdivision 25, snowmobile or boat, or on or about the 
  1.15  person's clothes or the person, or otherwise in possession or 
  1.16  control in a public place or public area without first having 
  1.17  obtained a permit to carry the pistol is guilty of a gross 
  1.18  misdemeanor.  A person who is convicted a second or subsequent 
  1.19  time is guilty of a felony.  
  1.20     (b) A person who has been issued a permit and who engages 
  1.21  in activities other than those for which the permit has been 
  1.22  issued, is guilty of a misdemeanor. 
  1.23     Sec. 2.  Minnesota Statutes 1994, section 624.714, 
  1.24  subdivision 9, is amended to read: 
  1.25     Subd. 9.  [CARRYING PISTOLS ABOUT ONE'S PREMISES OR FOR 
  1.26  PURPOSES OF REPAIR, TARGET PRACTICE.] A permit to carry is not 
  2.1   required of a person: 
  2.2      (a) To keep or carry about the person's place of business, 
  2.3   dwelling house, motor home, as defined in section 168.011, 
  2.4   subdivision 25, travel trailer, as defined in section 168.011, 
  2.5   subdivision 8, premises, or on land possessed by the person a 
  2.6   pistol; 
  2.7      (b) To carry a pistol from a place of purchase to the 
  2.8   person's dwelling house or place of business, or from the 
  2.9   person's dwelling house or place of business to or from a place 
  2.10  where repairing is done, to have the pistol repaired; 
  2.11     (c) To carry a pistol between the person's dwelling house 
  2.12  and place of business; 
  2.13     (d) To carry a pistol in the woods or fields or upon the 
  2.14  waters of this state for the purpose of hunting or of target 
  2.15  shooting in a safe area; or 
  2.16     (e) To transport a pistol in a motor vehicle other than a 
  2.17  motor home, as defined in section 168.011, subdivision 25, 
  2.18  snowmobile, or boat if the pistol is unloaded, contained in a 
  2.19  closed and fastened case, gunbox, or securely tied package. 
  2.20     Sec. 3.  [EFFECTIVE DATE.] 
  2.21     Sections 1 and 2 are effective August 1, 1995, and apply to 
  2.22  crimes committed on or after that date.
