  1.1                          A bill for an act 
  1.2             relating to building codes; requiring certain modular 
  1.3             residential structures and prefabricated homes to be 
  1.4             in compliance with certain building codes; requiring 
  1.5             certain inspections; providing for rulemaking; 
  1.6             proposing coding for new law in Minnesota Statutes, 
  1.7             chapter 16B. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [16B.736] [MODULAR RESIDENTIAL STRUCTURES AND 
  1.10  PREFABRICATED HOMES.] 
  1.11     (a) A modular residential or commercial structure or a 
  1.12  prefabricated home placed in Minnesota must be constructed in 
  1.13  compliance with the State Building Code or the building code of 
  1.14  a jurisdiction that has not adopted the State Building Code if 
  1.15  it is placed in that jurisdiction. 
  1.16     (b) The manufacturer of a modular residential or commercial 
  1.17  structure or prefabricated home that is (1) built in a factory 
  1.18  located in this state or elsewhere, and (2) intended to be 
  1.19  assembled and placed in this state, must contract with a third 
  1.20  party for inspection of the structure or home to certify that it 
  1.21  complies with all applicable portions of the State Building Code 
  1.22  during the manufacturing process.  The commissioner shall adopt 
  1.23  rules for approval of inspectors required by this paragraph and 
  1.24  specifying their inspection procedures.  This paragraph does not 
  1.25  apply to a manufacturer of fewer than six structures or homes 
  1.26  per year.
