A bill for an act
relating to transportation; highways; regulating stormwater holding ponds;
proposing coding for new law in Minnesota Statutes, chapter 160.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin A road authority may not maintain a holding pond, including but not limited to a
detention pond or a retention pond, within the road right-of-way unless the pond is:

new text begin (1) designed with a maximum depth of three feet following peak discharge from
weather events; or
new text end

new text begin (2) separated from all adjacent roadways by a cable median barrier, or other traffic
barrier, capable of preventing a motor vehicle from entering the pond when traveling at
speeds typical for the adjacent road.

Sec. 2. new text begin ROAD AUTHORITIES; HOLDING POND IMPLEMENTATION.

new text begin (a) For purposes of this section, "road authority" has the meaning given under
Minnesota Statutes, section 160.02, subdivision 25.

new text begin (b) Notwithstanding Minnesota Statutes, section 160.202, a road authority shall
meet the requirements under that section by November 1, 2015, for any holding pond
established before the effective date of this act.
