  1.1                          A bill for an act 
  1.2             relating to crime victims; extending the time for 
  1.3             receipt of reparations; amending Minnesota Statutes 
  1.4             1998, section 611A.54. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1998, section 611A.54, is 
  1.7   amended to read: 
  1.8      611A.54 [AMOUNT OF REPARATIONS.] 
  1.9      Reparations shall equal economic loss except that: 
  1.10     (1) reparations shall be reduced to the extent that 
  1.11  economic loss is recouped from a collateral source or collateral 
  1.12  sources.  Where compensation is readily available to a claimant 
  1.13  from a collateral source, the claimant must take reasonable 
  1.14  steps to recoup from the collateral source before claiming 
  1.15  reparations; 
  1.16     (2) reparations shall be denied or reduced to the extent, 
  1.17  if any, that the board deems reasonable because of the 
  1.18  contributory misconduct of the claimant or of a victim through 
  1.19  whom the claimant claims; and 
  1.20     (3) reparations paid to all claimants suffering economic 
  1.21  loss as the result of the injury or death of any one victim 
  1.22  shall not exceed $50,000.  
  1.23     No employer may deny an employee an award of benefits based 
  1.24  on the employee's eligibility or potential eligibility for 
  1.25  reparations.  
  2.1      Compensation for loss of income shall be reviewed at 26 
  2.2   weeks.  If the victim's disability continues past 26 weeks, the 
  2.3   victim may continue to receive compensation up to an amount 
  2.4   totaling $50,000 provided that an evaluation by a physician 
  2.5   states that the victim continues to be disabled. 
  2.6      Sec. 2.  [EFFECTIVE DATE.] 
  2.7      Section 1 is effective for all claims commenced on or after 
  2.8   August 1, 2000.
