  1.1                          A bill for an act
  1.2             relating to crime prevention; increasing the penalty 
  1.3             for repeated indecent exposure in the presence of a 
  1.4             minor; amending Minnesota Statutes 1995 Supplement, 
  1.5             section 617.23. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1995 Supplement, section 
  1.8   617.23, is amended to read: 
  1.9      617.23 [INDECENT EXPOSURE; PENALTIES.] 
  1.10     (a) A person is guilty of a misdemeanor who in any public 
  1.11  place, or in any place where others are present:  
  1.12     (1) willfully and lewdly exposes the person's body, or the 
  1.13  private parts thereof; 
  1.14     (2) procures another to expose private parts; or 
  1.15     (3) engages in any open or gross lewdness or lascivious 
  1.16  behavior, or any public indecency other than behavior specified 
  1.17  in clause (1) or (2) or this clause. 
  1.18     (b) A person is guilty of a gross misdemeanor if: 
  1.19     (1) the person violates this section in the presence of a 
  1.20  minor under the age of 16; or 
  1.21     (2) the person violates this section after having been 
  1.22  previously convicted of violating this section, sections 609.342 
  1.23  to 609.3451, or a statute from another state in conformity with 
  1.24  any of those sections. 
  1.25     (c) A person is guilty of a felony and may be sentenced to 
  2.1   imprisonment for not more than five years or to payment of a 
  2.2   fine of not more than $10,000, or both, if the person violates 
  2.3   this section in the presence of a minor under the age of 16 
  2.4   after having been previously convicted of violating this 
  2.5   section, or a statute from another state in conformity with this 
  2.6   section, in the presence of a minor under the age of 16. 
  2.7      Sec. 2.  [EFFECTIVE DATE.] 
  2.8      Section 1 is effective August 1, 1996, and applies to 
  2.9   crimes committed on or after that date.
