  1.1                          A bill for an act 
  1.2             relating to local government; directing the 
  1.3             commissioner of agriculture to suspend ethanol 
  1.4             payments to Gopher State Ethanol upon adoption of a 
  1.5             resolution by the St. Paul city council. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [GOPHER STATE ETHANOL PLANT ODOR.] 
  1.8      If the city council of the city of Saint Paul notifies the 
  1.9   commissioner of agriculture that the council has adopted a 
  1.10  resolution determining that the odor problems at Gopher State 
  1.11  Ethanol have continued for a period of 30 days or longer after 
  1.12  installation of the thermal oxidizer, the commissioner shall 
  1.13  immediately suspend all ethanol producer payments to Gopher 
  1.14  State Ethanol under Minnesota Statutes, section 41A.09, 
  1.15  subdivision 3a.  The commissioner must not make ethanol producer 
  1.16  payments for any quarter during which a negative resolution of 
  1.17  the city council is in effect.  Payments may resume for 
  1.18  production during quarters following a resolution of the city 
  1.19  council determining that odor problems at the ethanol plant have 
  1.20  been corrected.  Payments foregone during a period of suspension 
  1.21  are not eligible for catch-up payments under Minnesota Statutes, 
  1.22  section 41A.09, subdivision 3a, paragraph (j).
