  1.1                          A bill for an act 
  1.2             relating to human services; placing conditions on a 
  1.3             pharmacy's participation in the medical assistance 
  1.4             program; amending Minnesota Statutes 1998, section 
  1.5             256B.0625, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 256B.0625, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 13c.  [PHARMACY PROVIDERS.] (a) In addition to the 
  1.10  vendor and provider requirements for participation in the 
  1.11  medical assistance program, a pharmacy may participate in the 
  1.12  medical assistance program as a covered provider if the pharmacy 
  1.13  agrees to charge Medicare beneficiaries a price for prescription 
  1.14  drugs that does not exceed the medical assistance reimbursement 
  1.15  rate. 
  1.16     (b) Medicare beneficiaries must provide a valid 
  1.17  prescription and a Medicare card.  Medicare beneficiaries may 
  1.18  not receive any medical assistance reimbursement rate for 
  1.19  over-the-counter drugs or compounded prescriptions. 
  1.20     (c) The commissioner shall monitor pharmacy compliance and 
  1.21  make annual reports to the legislature on pharmacy compliance. 
  1.22     (d) This subdivision is effective until the federal 
  1.23  Medicare program provides prescription drug coverage to all 
  1.24  Medicare recipients in Minnesota.  The commissioner shall notify 
  1.25  the legislature when prescription drug coverage is added to the 
  2.1   Medicare program. 
  2.2      Sec. 2.  [EFFECTIVE DATE.] 
  2.3      Section 1 is effective July 1, 2000.
