A bill for an act
relating to insurance; requiring health plans to provide coverage for
neuropsychological testing for children diagnosed with cancer; extending
medical assistance coverage to neuropsychological testing for children diagnosed
with cancer; amending Minnesota Statutes 2006, section 256B.0625, by adding a
subdivision; proposing coding for new law in Minnesota Statutes, chapter 62A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

DIAGNOSED WITH CANCER.

new text begin Required coverage. new text end

new text begin Any health plan that provides coverage for
cancer treatment must provide coverage to a covered individual under the age of 25 who
has been diagnosed with cancer on or after January 1, 2000, for neuropsychological testing
ordered by a licensed physician to assess the extent of any cognitive or developmental
delays due to chemotherapy or radiation treatment.

new text begin The health plan may not impose a prior
authorization requirement or a special deductible, coinsurance, or co-payment on the
coverage described in subdivision 1 that is not generally applicable to other coverage
under the health plan.

Sec. 2.

Minnesota Statutes 2006, section 256B.0625, is amended by adding a
subdivision to read:

new text begin Effective July 1, 2008, medical assistance covers neuropsychological testing ordered by a
licensed physician for children who have been diagnosed with cancer on or after January
1, 2000, to assess the extent of any cognitive or developmental delays in the child due
to chemotherapy or radiation treatment.

Sec. 3. new text begin EFFECTIVE DATE.

July 1, 2008.
