A bill for an act
 relating to family law; providing for termination of spousal maintenance based on
cohabitation; amending Minnesota Statutes 2008, section 518A.39, subdivision 3.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 518A.39, subdivision 3, is amended to
read:


Subd. 3.

Maintenance on death or, remarriage, or cohabitation.

Unless
otherwise agreed in writing or expressly provided in the decree, the obligation to pay
future maintenance is terminated upon:

(1) the death of either party or;

(2) the remarriage of the party receiving maintenance; or

(3) cohabitation by the party receiving maintenance with a nonrelated person of
the opposite sex for six months or longer.
