A bill for an act
 relating to family law; providing for termination of spousal maintenance based on
cohabitation; amending Minnesota Statutes 2008, section 518A.39, subdivision 3.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 518A.39, subdivision 3, is amended to
read:


Subd. 3.

Maintenance on death deleted text begin ordeleted text end new text begin ,new text end remarriagenew text begin , or cohabitationnew text end .

Unless
otherwise agreed in writing or expressly provided in the decree, the obligation to pay
future maintenance is terminated uponnew text begin :

new text begin (2)new text end the remarriage of the party receiving maintenancenew text begin ; or
