  1.1                          A bill for an act 
  1.2             relating to retirement; Minneapolis teachers 
  1.3             retirement fund association; authorizing a current 
  1.4             plan member to purchase service credit for prior 
  1.5             nonprofit agency teaching service. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [RETIREMENT COVERAGE BY MINNEAPOLIS TEACHERS 
  1.8   RETIREMENT FUND ASSOCIATION FOR CERTAIN PRIOR NONPROFIT AGENCY 
  1.9   SERVICE.] 
  1.10     Subdivision 1.  [ELIGIBLE TEACHER.] (a) A teacher described 
  1.11  in paragraph (b) is eligible for the retirement coverage 
  1.12  specified in subdivision 2. 
  1.13     (b) An eligible teacher is a person who: 
  1.14     (1) was born on June 30, 1946; 
  1.15     (2) was first employed as a teacher by special school 
  1.16  district No. 1 on August 31, 1987; 
  1.17     (3) became a Minneapolis teachers retirement fund 
  1.18  association member on September 16, 1987; 
  1.19     (4) was hired by the Loring Nicollet Bethlehem Community 
  1.20  Center to be the lead teacher in the Loring Nicollet Bethlehem 
  1.21  alternative school in the fall of 1972; and 
  1.22     (5) became a certified teacher by or on September 9, 1975. 
  1.23     Subd. 2.  [RETIREMENT COVERAGE.] An eligible teacher under 
  1.24  subdivision 1 is entitled to service credit in the Minneapolis 
  1.25  teachers retirement fund association for the eligible teacher's 
  2.1   employment by the Loring Nicollet Bethlehem alternative school 
  2.2   upon payment of the amount specified in subdivision 3.  The 
  2.3   period or periods eligible for service credit purchase are those 
  2.4   during which the eligible teacher provided teaching services and 
  2.5   was a certified teacher.  The eligible teacher may not purchase 
  2.6   service credit for any period for which the individual currently 
  2.7   has service credit in the Minneapolis teachers retirement fund 
  2.8   association or is eligible to receive that service credit.  An 
  2.9   eligible employee may not purchase service credit for any period 
  2.10  during which the employer has made contributions on behalf of 
  2.11  the employee to a defined contribution pension plan or for any 
  2.12  period during which the employee or the employer have made 
  2.13  contributions to a defined benefit pension plan covering public, 
  2.14  nonprofit, or private sector employees other than a volunteer 
  2.15  firefighters relief association governed by Minnesota Statutes, 
  2.16  chapter 424A. 
  2.17     Subd. 3.  [AMOUNT.] An eligible teacher may purchase 
  2.18  allowable service credit in the Minneapolis teachers retirement 
  2.19  fund association by paying the amount specified in Minnesota 
  2.20  Statutes, section 356.55, before the date specified in paragraph 
  2.21  (b).  If the school district agrees to make a payment under 
  2.22  Minnesota Statutes, section 356.55, subdivision 5, the eligible 
  2.23  teacher must make the employee payments before the date 
  2.24  specified in paragraph (b).  If the employee payment is made in 
  2.25  a timely fashion, the school district payment must be remitted 
  2.26  60 days thereafter. 
  2.27     (b) Authority for an eligible teacher to make payments 
  2.28  under paragraph (a) expires on January 1, 2001, or upon 
  2.29  termination of service covered by the Minneapolis teachers 
  2.30  retirement fund association, whichever is earlier. 
  2.31     Subd. 4.  [REQUIRED DOCUMENTATION.] An eligible teacher 
  2.32  must provide any relevant documentation required by the 
  2.33  executive director to determine eligibility for the prior 
  2.34  service credit under this section. 
  2.35     Subd. 5.  [SERVICE CREDIT GRANT.] Service credit for the 
  2.36  purchase period must be granted by the Minneapolis teachers 
  3.1   retirement fund association to the account of the eligible 
  3.2   teacher upon receipt of the purchase payment amount specified in 
  3.3   subdivision 3. 
  3.4      Sec. 2.  [EFFECTIVE DATE.] 
  3.5      Section 1 is effective on the day following final enactment.
