  1.1                          A bill for an act 
  1.2             relating to group residential housing; clarifying a 
  1.3             rate exception; amending Minnesota Statutes 1994, 
  1.4             section 256I.05, subdivision 2. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1994, section 256I.05, 
  1.7   subdivision 2, is amended to read: 
  1.8      Subd. 2.  [MONTHLY RATES; EXEMPTIONS.] The maximum group 
  1.9   residential housing rate does not apply to a residence that on 
  1.10  August 1, 1984, was licensed by the commissioner of health only 
  1.11  as a boarding care home, certified by the commissioner of health 
  1.12  as an intermediate care facility, and licensed by the 
  1.13  commissioner of human services under Minnesota Rules, parts 
  1.14  9520.0500 to 9520.0690.  Notwithstanding the provisions of 
  1.15  subdivision 1c, the rate paid to a facility reimbursed under 
  1.16  this subdivision shall be determined under Minnesota Rules, 
  1.17  parts 9510.0010 to 9510.0480.
