A bill for an act
relating to data practices; limiting fees for driver's
license checks; amending Minnesota Statutes 2004,
section 171.321, subdivision 5.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 171.321,
subdivision 5, is amended to read:


Subd. 5.

Annual evaluation and license verification.

(a)
A school district, nonpublic school, or private contractor shall
provide in-service training annually to each school bus driver.

(b) A school district, nonpublic school, or private
contractor shall annually verify the validity of the driver's
license of each employee who regularly transports students for
the district in a type A school bus, a type B school bus, a type
C school bus, or type D school bus, or regularly transports
students for the district in a type III vehicle with the
National Driver Register or with the Department of Public Safety.

new text begin (c) Members of a nonprofit bus drivers' trade association
under private contract with an independent school district shall
not be charged a fee greater than the fee, if any, imposed upon
an independent school district for accessing an employee's
driver's license records from the Department of Public Safety in
compliance with this section.
