A bill for an act
relating to water; requiring rulemaking for shallow lakes; requiring review and
report on rules for shallow lakes.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin PESTICIDE CONTROL OF AQUATIC PLANTS IN SHALLOW LAKES;
RULE AMENDMENT.

new text begin (a) The commissioner of natural resources must amend Minnesota Rules, part 6280.0350,
subpart 4, to allow pesticide control of aquatic plants in public waters to be used for up to
50 percent of the littoral area of a shallow lake.

new text begin (b) The commissioner may use the good cause exemption under Minnesota Statutes,
section 14.388, subdivision 1, clause (3), to adopt rules under this section, and Minnesota
Statutes, section 14.386, does not apply except as provided under Minnesota Statutes, section
14.388.

Sec. 2. new text begin REVIEW AND REPORT ON ADMINISTRATIVE TREATMENT OF
SHALLOW LAKES.

new text begin The commissioner of natural resources must review department administrative rules
affecting public waters and determine whether those rules adequately take into account the
unique hydrology and properties of shallow lakes. By February 1, 2020, the commissioner
must submit the commissioner's findings and recommendations to the chairs and ranking
minority members of the senate and house of representatives committees and divisions with
jurisdiction over the environment and natural resources.
