A bill for an act
relating to commerce; requiring disclosure of cosmetic fragrance ingredients;
proposing coding for new law in Minnesota Statutes, chapter 325E.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin For purposes of this section, "cosmetic" means:

new text begin (1) articles intended to be rubbed, poured, sprinkled, or sprayed on, introduced into, or
otherwise applied to the human body or any part of the human body for cleansing,
beautifying, promoting attractiveness, or altering the appearance; and

new text begin (2) articles intended for use as a component of any articles in clause (1), except that the
term does not include soap.

new text begin (a) A manufacturer of a cosmetic manufactured, distributed, or
offered for retail sale in Minnesota shall disclose on the manufacturer's Web site the full
list of ingredients in the product, including the component ingredients of fragrances, flavors,
and color additives. The Chemical Abstract Service (CAS) number or International
Nomenclature of Cosmetic Ingredients (INCI) name of each ingredient must be included
on the ingredient list provided on the manufacturer's Web site.

new text begin (b) The ingredients must be listed in descending order of predominance, except that an
ingredient present at a concentration of not more than one percent may be listed without
respect to order of predominance.

new text begin (c) The manufacturer is not required to list the concentration of an ingredient in the
product on the manufacturer's Web site.

new text begin (d) A cosmetic ingredient must be identified in the declaration of ingredients in
accordance with Code of Federal Regulations, title 21, section 701.3(c).
