  1.1                          A bill for an act 
  1.2             relating to health; exempting certain prescriptions 
  1.3             from bearing a federal drug enforcement administration 
  1.4             registration number; restricting the use and the 
  1.5             release of the federal drug enforcement administration 
  1.6             registration number; amending Minnesota Statutes 1996, 
  1.7             section 152.11, by adding subdivisions. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1996, section 152.11, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 2a.  [FEDERAL REGISTRATION NUMBER EXEMPTION.] A 
  1.12  prescription need not bear a federal drug enforcement 
  1.13  administration registration number that authorizes the 
  1.14  prescriber to prescribe controlled substances if the drug 
  1.15  prescribed is not a controlled substance in schedule II, III, 
  1.16  IV, or V.  No person shall impose a requirement inconsistent 
  1.17  with this subdivision. 
  1.18     Sec. 2.  Minnesota Statutes 1996, section 152.11, is 
  1.19  amended by adding a subdivision to read: 
  1.20     Subd. 2b.  [RESTRICTION ON RELEASE OF FEDERAL REGISTRATION 
  1.21  NUMBER.] No person or entity may offer for sale, sell, lease, or 
  1.22  otherwise release a federal drug enforcement administration 
  1.23  registration number for any reason, except for drug enforcement 
  1.24  purposes authorized by this chapter and the federal controlled 
  1.25  substances registration system.  For purposes of this section, 
  1.26  an entity includes a state governmental agency or regulatory 
  2.1   board, a health plan company as defined under section 62Q.01, 
  2.2   subdivision 4, a managed care organization as defined under 
  2.3   section 62Q.01, subdivision 5, or any other entity that 
  2.4   maintains prescription data. 
  2.5      Sec. 3.  Minnesota Statutes 1996, section 152.11, is 
  2.6   amended by adding a subdivision to read: 
  2.7      Subd. 2c.  [RESTRICTION ON USE OF FEDERAL REGISTRATION 
  2.8   NUMBER.] No entity may use a federal drug enforcement 
  2.9   administration registration number to identify or monitor the 
  2.10  prescribing practices of a prescriber to whom that number has 
  2.11  been assigned, except for drug enforcement purposes authorized 
  2.12  by this chapter and the federal controlled substances 
  2.13  registration system.  For purposes of this section, an entity 
  2.14  includes a health plan company as defined under section 62Q.01, 
  2.15  subdivision 4, a managed care organization as defined under 
  2.16  section 62Q.01, subdivision 5, or any other entity that 
  2.17  maintains prescription data. 
  2.18     Sec. 4.  [EFFECTIVE DATE.] 
  2.19     Sections 1 to 3 are effective 24 months after the date on 
  2.20  which a unique health identifier is adopted or established under 
  2.21  United States Code, title 42, sections 1320d to 1320d-8 (1996 
  2.22  and subsequent amendments).
