A bill for an act
relating to retirement; Public Employees Retirement Association; transferring 911
telecommunicators from the general employees retirement plan to the local
government correctional plan and transferring eligible service credit; amending
Minnesota Statutes 2020, section 353E.02, subdivision 1, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 353E.02, subdivision 1, is amended to read:


Subdivision 1.

Retirement coverage.

The members of the local government correctional
service retirement plan established by this chapter are:

(1) local government correctional service employees as defined in subdivision 2; deleted text begin and

(2) medical center protection officers as defined in subdivision 2anew text begin ; and

new text begin (3) 911 telecommunicators as defined in subdivision 2bnew text end .

Sec. 2.

Minnesota Statutes 2020, section 353E.02, is amended by adding a subdivision to
read:

new text begin 911 telecommunicators. new text end

new text begin (a) A 911 telecommunicator, for the purposes of
subdivision 1, is a person whom the employer certifies:

new text begin (1) is employed as a 911 telecommunicator as defined under section 403.02, subdivision
17c; and
new text end

new text begin (2) is a "public employee" as defined in section 353.01, but is not a member of the public
employees police and fire plan.

new text begin (b) The certification required under paragraph (a) must be made in writing on a form
prescribed by the executive director of the Public Employees Retirement Association.

new text begin (c) Allowable service in the general employees retirement plan credited to a 911
telecommunicator before July 1, 2022, remains in the general employees retirement plan
unless transferred under section 3.

Sec. 3. new text begin REQUIRING THE TRANSFER OF ALLOWABLE SERVICE FOR 911
TELECOMMUNICATORS.

new text begin Definitions. new text end

new text begin The following terms as used in this section have the meanings
given in this subdivision:

new text begin (1) "Correctional plan" means the public employees local government correctional
service retirement plan.
new text end

new text begin (2) "Employer" means a governmental subdivision, as defined under Minnesota Statutes,
section 353.01, subdivision 6, that on the effective date employs an eligible 911
telecommunicator under subdivision 3.

new text begin (3) "Executive director" means the executive director of the Public Employees Retirement
Association.

new text begin (4) "General plan" means the general employees retirement plan of the Public Employees
Retirement Association.

new text begin Transfer of allowable service credit authorized. new text end

new text begin The executive director shall,
for each eligible 911 telecommunicator defined in subdivision 3, transfer eligible service
credit, defined under subdivision 4, from the general plan to the correctional plan. The
transfer of eligible service credit must occur within 90 days following the effective date.

new text begin A person is an eligible 911 telecommunicator
if on the effective date the person is a 911 telecommunicator under Minnesota Statutes,
section 353E.02, subdivision 2b.

new text begin Eligible service credit. new text end

new text begin (a) Eligible service credit is allowable service in the
general plan that was credited:
new text end

new text begin (1) to the 911 telecommunicator before the effective date;
new text end

new text begin (2) for employment with the 911 telecommunicator's employer; and
new text end

new text begin (3) for employment as a 911 telecommunicator as defined under Minnesota Statutes,
section 403.02, subdivision 17c.

new text begin (b) Within 30 days following the effective date, for each eligible 911 telecommunicator
the employer must certify eligible service credit to the executive director. The certification
must be on a form prescribed by the executive director.

new text begin Subd. 5. new text end

new text begin Transfer of assets. new text end

new text begin For each eligible 911 telecommunicator, the executive
director shall transfer assets from the general employees retirement fund to the public
employees local government correctional service retirement fund. The amount of the assets
transferred for each 911 telecommunicator must be equal to the greater of:

new text begin (1) the 911 telecommunicator's employee and employer contributions to the general plan
for the period of eligible service credit plus interest at the applicable annual rate or rates
under Minnesota Statutes, section 356.59, subdivision 3, from the date the contributions
were made to the date of the transfer; or

new text begin (2) the amount of the reduction in the actuarial present value of the benefit payable from
the general plan because of the transfer of eligible service credit.

new text begin Additional employer contribution. new text end

new text begin (a) The employer of each eligible 911
telecommunicator shall contribute on behalf of the 911 telecommunicator to the public
employees local government correctional service retirement fund the amount described
under paragraph (b).

new text begin (b) For each eligible 911 telecommunicator, the executive director shall calculate an
amount equal to the actuarial accrued liability in the correctional plan attributable to the
transfer of eligible service credit less the amount of the assets transferred under subdivision
5.

new text begin (c) The executive director shall notify the employer of the amount under paragraph (b)
within 60 days following the effective date. The employer shall contribute the amount under
paragraph (b) within 30 days following receipt of the notice.

new text begin Within 90 days following the effective date, the executive director shall
notify each eligible 911 telecommunicator of the transfer of service credit provided in this
section.

Sec. 4. new text begin EFFECTIVE DATE.
