  1.1                          A bill for an act
  1.2             relating to housing; permitting a mortgagee to provide 
  1.3             a resident caretaker for a premises; authorizing entry 
  1.4             into tenant's premises under certain circumstances; 
  1.5             amending Minnesota Statutes 1994, section 582.031, 
  1.6             subdivision 2; Minnesota Statutes 1995 Supplement, 
  1.7             section 504.183, subdivision 3. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1995 Supplement, section 
  1.10  504.183, subdivision 3, is amended to read: 
  1.11     Subd. 3.  [REASONABLE PURPOSE.] For purposes of subdivision 
  1.12  2, a reasonable business purpose includes, but is not limited to:
  1.13     (1) showing the unit to prospective tenants during the 
  1.14  notice period before the lease terminates or after the current 
  1.15  tenant has given notice to move to the owner or owner's agent; 
  1.16     (2) showing the unit to a prospective buyer or to an 
  1.17  insurance representative; 
  1.18     (3) performing maintenance work; 
  1.19     (4) allowing inspections by state, county, or city 
  1.20  officials charged in the enforcement of health, housing, 
  1.21  building, fire prevention, or housing maintenance codes; 
  1.22     (5) the tenant is causing a disturbance within the unit; 
  1.23     (6) the landlord has a reasonable belief that the tenant is 
  1.24  violating the lease within the tenant's unit; 
  1.25     (7) prearranged housekeeping work in senior housing where 
  1.26  80 percent or more of the tenants are age 55 or older; 
  2.1      (8) the landlord has a reasonable belief that the unit is 
  2.2   being occupied by an individual without a legal right to occupy 
  2.3   it; or 
  2.4      (8) (9) the tenant has vacated the unit. 
  2.5      Sec. 2.  Minnesota Statutes 1994, section 582.031, 
  2.6   subdivision 2, is amended to read: 
  2.7      Subd. 2.  [AUTHORIZED ACTIONS.] The holder of the mortgage 
  2.8   or sheriff's certificate may take the following actions to 
  2.9   protect the premises from waste:  install or change locks on 
  2.10  doors and windows, board windows, provide a resident caretaker, 
  2.11  and otherwise prevent or minimize damage to the premises from 
  2.12  the elements, vandalism, trespass, or other illegal activities.  
  2.13  If the holder of the mortgage or sheriff's certificate installs 
  2.14  or changes locks under this section, a key to the premises must 
  2.15  be promptly delivered to the mortgagor or any person lawfully 
  2.16  claiming through the mortgagor, upon request.
