A bill for an act
relating to unemployment insurance; local government; limiting eligibility for
unemployment benefits for certain seasonal municipal workers; amending
Minnesota Statutes 2010, section 268.085, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2010, section 268.085, is amended by adding a
subdivision to read:

new text begin Municipal seasonal employees. new text end

new text begin Unemployment benefits must not be
paid to an applicant on the basis of any wage credits from employment that consists of
seasonal work for a municipality, including work in a seasonal recreational facility, during
the period between two successive seasons, or similar periods, if:

new text begin (1) the applicant was employed by the municipality for no more than 700 hours in
the 12 months preceding the application for benefits;
new text end

new text begin (2) the applicant was so employed by the municipality in the prior season or similar
period;
new text end

new text begin (3) there is a reasonable assurance that the applicant will be so employed in the
following season or similar period with the same municipality; and

new text begin (4) all of the wage credits from that municipality were earned performing seasonal
work assignments.
