  1.1                          A bill for an act 
  1.2             relating to the environment; modifying eligibility of 
  1.3             small gasoline retailers for loans and grants for 
  1.4             underground storage tank replacement; amending 
  1.5             Minnesota Statutes 1997 Supplement, section 115C.09, 
  1.6             subdivision 3f. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1997 Supplement, section 
  1.9   115C.09, subdivision 3f, is amended to read: 
  1.10     Subd. 3f.  [REIMBURSEMENTS; SMALL GASOLINE RETAILERS.] (a) 
  1.11  As used in this subdivision, "small gasoline retailer" means a 
  1.12  responsible person who owns no more than one location where 
  1.13  motor fuel was dispensed into motor vehicles or aircraft in the 
  1.14  previous year. 
  1.15     (b) For eligible applicants who are small gasoline 
  1.16  retailers that have dispensed less than 500,000 gallons of motor 
  1.17  fuel during the most recent calendar year that petroleum 
  1.18  products were dispensed at the location owned by the retailer, 
  1.19  the board shall reimburse the applicant for 90 percent of the 
  1.20  applicant's total reimbursable cost for tank removal projects 
  1.21  started after January 1, 1997 October 1, 1996, including, but 
  1.22  not limited to, closure in place, backfill, resurfacing, and 
  1.23  utility service restoration costs, provided that the tank 
  1.24  involved is a regulated underground storage tank. 
  1.25     (c) For eligible applicants who are small gasoline 
  1.26  retailers that have dispensed less than 250,000 gallons of motor 
  2.1   fuel during the most recent calendar year that petroleum 
  2.2   products were dispensed at the location owned by the retailer, 
  2.3   provided that the tank involved is a regulated underground 
  2.4   storage tank, the board shall reimburse the applicant for 95 
  2.5   percent of the following costs: 
  2.6      (1) tank removal costs described in paragraph (b); and 
  2.7      (2) petroleum contamination cleanup as provided under 
  2.8   subdivision 1. 
  2.9      (d) This subdivision expires January 1, 2000. 
  2.10     Sec. 2.  [EFFECTIVE DATE.] 
  2.11     This act is effective the day following final enactment.
