A bill for an act
relating to game and fish; modifying method of distributing turkey licenses;
amending Minnesota Statutes 2010, section 97A.435, subdivision 2.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2010, section 97A.435, subdivision 2, is amended to
read:


Subd. 2.

new text begin (a) new text end Persons eligible for a turkey
license shall be determined by this section and commissioner's rule.

new text begin (b) new text end A person is eligible for a turkey license only if the person is at least age 16
before the season opens, possesses a firearms safety certificate, or, if under age 12, is
accompanied by a parent or guardian.

new text begin (c) All eligible persons age 65 and over who apply for a turkey license shall be issued
a turkey license, provided the number of applicants under this paragraph does not exceed
the number of licenses to be issued as determined according to subdivision 1. If the number
of applicants under this paragraph exceeds the number of licenses to be issued, all turkey
licenses shall be distributed by lottery drawing, regardless of the age of the applicant.

new text begin (d) All remaining licenses after distribution according to paragraph (c) shall be
distributed by lottery drawing, except as provided under subdivision 4.

Sec. 2. new text begin RULEMAKING.

new text begin The commissioner of natural resources shall amend Minnesota Rules, chapter
6236, to conform with section 1. The commissioner may use the good cause exemption
under Minnesota Statutes, section 14.388, subdivision 1, clause (3), to adopt rules under
this section. Minnesota Statutes, section 14.386, does not apply except as provided in
Minnesota Statutes, section 14.388.
