A bill for an act
relating to health care; permitting a family or individual who is eligible for medical
assistance to enroll in MinnesotaCare; amending Minnesota Statutes 2018, section
256L.04, subdivision 14.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 256L.04, subdivision 14, is amended to read:


Subd. 14.

Coordination with medical assistance.

(a) deleted text begin Individuals eligible for medical
assistance under chapter 256B are not eligible for MinnesotaCare under this section.

Notwithstanding subdivisions 1 and 7, families and individuals who are eligible for medical
assistance have the option of enrolling in MinnesotaCare if the requirements in section
256L.07 are met and the applicable premium is paid in accordance with section 256L.15.
If a family or individual elects to enroll in MinnesotaCare instead of medical assistance,
the provisions of this chapter shall apply.

(b) The commissioner shall coordinate eligibility and coverage to ensure that individuals
transitioning between medical assistance and MinnesotaCare have seamless eligibility and
access to health care services.

new text begin The commissioner shall seek all federal waivers necessary to implement Minnesota
Statutes, section 256L.04, subdivision 14, paragraph (a). The commissioner shall seek
federal approval to ensure that the federal financial participation amount paid to the state
for any individual who elects to enroll in MinnesotaCare instead of medical assistance
continues to be paid at the amount the state would have received for that individual under
the medical assistance program.
