  1.1                          A bill for an act 
  1.2             relating to education; modifying the dates for payment 
  1.3             of school district state aids; authorizing an 
  1.4             additional appeal; amending Minnesota Statutes 1998, 
  1.5             section 127A.45, subdivisions 2, 3, and 4. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 127A.45, 
  1.8   subdivision 2, is amended to read: 
  1.9      Subd. 2.  [DEFINITIONS.] (a) The term "other district 
  1.10  receipts" means payments by county treasurers pursuant to 
  1.11  section 276.10, apportionments from the school endowment fund 
  1.12  pursuant to section 127A.33, apportionments by the county 
  1.13  auditor pursuant to section 127A.34, subdivision 2, and payments 
  1.14  to school districts by the commissioner of revenue pursuant to 
  1.15  chapter 298.  
  1.16     (b) The term "cumulative amount guaranteed" means the sum 
  1.17  of the following: 
  1.18     (1) one-third of the final adjustment payment according to 
  1.19  subdivision 9; plus 
  1.20     (2) the product of 
  1.21     (i) the cumulative disbursement percentage shown in 
  1.22  subdivision 3; times 
  1.23     (ii) the sum of 
  1.24     90 percent of the estimated aid and credit entitlements 
  1.25  paid according to subdivision 13; plus 
  2.1      100 percent of the entitlements paid according to 
  2.2   subdivisions 11 and 12; plus 
  2.3      the other district receipts; plus 
  2.4      the final adjustment payment according to subdivision 9.  
  2.5      (c) The term "payment date" means the date on which state 
  2.6   payments to districts are made by the electronic funds transfer 
  2.7   method.  If a payment date falls on a Saturday, a Sunday, or a 
  2.8   weekday which is a legal holiday, the payment shall be made on 
  2.9   the immediately following preceding business day.  The 
  2.10  commissioner may make payments on dates other than those listed 
  2.11  in subdivision 3, but only for portions of payments from any 
  2.12  preceding payment dates which could not be processed by the 
  2.13  electronic funds transfer method due to documented extenuating 
  2.14  circumstances.  
  2.15     Sec. 2.  Minnesota Statutes 1998, section 127A.45, 
  2.16  subdivision 3, is amended to read: 
  2.17     Subd. 3.  [PAYMENT DATES AND PERCENTAGES.] The commissioner 
  2.18  shall pay to a district on the dates indicated an amount 
  2.19  computed as follows:  the cumulative amount guaranteed minus the 
  2.20  sum of (a) the district's other district receipts through the 
  2.21  current payment, and (b) the aid and credit payments through the 
  2.22  immediately preceding payment.  For purposes of this 
  2.23  computation, the payment dates and the cumulative disbursement 
  2.24  percentages are as follows:

  3.25     Sec. 3.  Minnesota Statutes 1998, section 127A.45, 
  3.26  subdivision 4, is amended to read: 
  3.27     Subd. 4.  [APPEAL.] (a) The commissioner, in consultation 
  3.28  with the commissioner of finance, may revise the payment dates 
  3.29  and percentages in subdivision 3 for a district if it is 
  3.30  determined that: 
  3.31     (1) there is an emergency; or 
  3.32     (2) there are serious cash flow problems in the district 
  3.33  that cannot be resolved by issuing warrants or other forms of 
  3.34  indebtedness; or 
  3.35     (3) the district is facing a serious cash flow problem 
  3.36  because of an abatement.  
  4.1      (b) The commissioner shall establish a process and criteria 
  4.2   for districts to appeal the payment dates and percentages 
  4.3   established in subdivision 3.  
  4.4      Sec. 4.  [EFFECTIVE DATES.] 
  4.5      Sections 1 and 3 are effective the day following final 
  4.6   enactment.  Section 2 is effective July 1, 1999, and applies to 
  4.7   payment of state aids for fiscal years 2000 and later.
