A bill for an act
relating to animal health; modifying qualifications for certain board members;
amending Minnesota Statutes 2022, section 35.02, subdivision 2, by adding a
subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2022, section 35.02, subdivision 2, is amended to read:

Subd. 2.

Terms; compensation; removal; vacancies.

the board are governed by section 15.0575.

Sec. 2.

Minnesota Statutes 2022, section 35.02, is amended by adding a subdivision to
read:

new text begin Livestock producer board members. new text end

new text begin For purposes of this section, "producer
of livestock" and "livestock producer" mean a person who earned at least $78,000 of the
person's annual gross sales from the sale of livestock during the previous calendar year. If
a person who is a sitting livestock producer board member no longer meets the definition
of livestock producer, liquidates the person's livestock herd or poultry flock, or reduces the
person's herd or flock size such that earning $78,000 of annual gross sales is no longer
achievable, the person is immediately ineligible to finish the person's term as a board member
and the resulting vacancy must be filled as provided under this section.

applies both to sitting board members at the time of enactment and board members appointed
on or after that date.
