A bill for an act
relating to disaster assistance; reimbursing city of St. Charles for lost revenues
and adjusting pupil unit aid in response to the North Star Foods fire; appropriating
money.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin ST. CHARLES FIRE; DISASTER ASSISTANCE.

new text begin $388,000 for the remainder of the 2009 fiscal year and for the 2010 fiscal year (the
first year) and $430,000 for the 2011 fiscal year (the second year) is appropriated from
the general fund to the city of St. Charles to reimburse the city for its estimated losses in
revenues to the city due to the destruction by fire of North Star Foods facilities. These
lost revenues consist of:

new text begin (1) property tax revenues of approximately $31,000 the first year and $31,000 the
second year;

new text begin (2) electrical utility service revenues of approximately $253,000 the first year and
$291,000 the second year; and

new text begin (3) sewer and water services revenues of approximately $104,000 the first year and
$108,000 the second year.

Sec. 2. new text begin DECLINING PUPIL AID; ST. CHARLES SCHOOL DISTRICT.

new text begin Up to $242,500 for fiscal year 2010 and up to $242,500 for fiscal year 2011 is
appropriated from the general fund to the commissioner of education to be disbursed as a
grant to Independent School District No. 858, St. Charles, to compensate for declining
pupil unit aid equal to the greater of zero or the product of the general education revenue
basic formula allowance for that year and the difference between the district's February
2009 estimated adjusted marginal cost pupil units for that year and the district's actual
adjusted marginal cost pupil units for that year. Notwithstanding Minnesota Statutes,
section 126C.13, the amounts required under this section are included in the general
education aid payments for the district. If the appropriation for either year is insufficient,
the appropriation for the other year is available for it.
