  1.1                          A bill for an act 
  1.2             relating to natural resources; modifying provisions 
  1.3             for all-terrain vehicle use on certain wildlife 
  1.4             management area lands; modifying disposition of 
  1.5             lottery ticket in lieu of sales tax receipts; adding 
  1.6             to state wildlife management areas; providing for 
  1.7             certain land exchanges; permitting the sale of certain 
  1.8             consolidated conservation land in Roseau county; 
  1.9             amending Minnesota Statutes 2000, section 97A.133, 
  1.10            subdivision 3; Minnesota Statutes 2001 Supplement, 
  1.11            sections 297A.94; 477A.14. 
  1.12  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.13     Section 1.  Minnesota Statutes 2000, section 97A.133, 
  1.14  subdivision 3, is amended to read: 
  1.15     Subd. 3.  [ALL-TERRAIN VEHICLE TRAVEL WITHIN DESIGNATED 
  1.16  WILDLIFE MANAGEMENT AREAS.] (a) On lands acquired by the state 
  1.17  under chapter 84A that are designated after January 1, 1986, as 
  1.18  wildlife management areas, the commissioner shall, by January 
  1.19  15, 2003 2004, identify and, designate corridor, and sign at 
  1.20  least 90 miles of all-terrain vehicle trails, not including 
  1.21  public roads that are maintained and open to travel by other 
  1.22  noncommercial vehicles, in corridors of disturbance that: 
  1.23     (1) the commissioner determines are appropriate to connect 
  1.24  trails, forest roads established under section 89.71, 
  1.25  subdivision 1, and public highways to provide reasonable travel 
  1.26  for all-terrain vehicles; or 
  1.27     (2) are areas of historic all-terrain vehicle use, 
  1.28  including trails that end within a wildlife management area. 
  2.1      The designated trails must be either within or contiguous 
  2.2   to the wildlife management areas.  The commissioner shall 
  2.3   consult with wildlife management area users, including both 
  2.4   motorized and nonmotorized trail users, in identifying and 
  2.5   designating corridor trails under this paragraph.  Corridor 
  2.6   Trail establishment must be in compliance with other state and 
  2.7   federal law.  Local governments and other trail sponsors may 
  2.8   propose the designation of corridor trails, including the 
  2.9   designation as a grant-in-aid trail for the purposes of funding 
  2.10  under section 84.927, subdivision 2. 
  2.11     (b) The following forest roads shall be open to travel by 
  2.12  all-terrain vehicles when the roads are open to other 
  2.13  noncommercial vehicles: 
  2.14     (1) the Rapid River forest road, beginning at the west 
  2.15  boundary of the Red Lake wildlife management area at the 
  2.16  southwest corner of Section 7, Township 156 North, Range 35 
  2.17  West, Beltrami county, thence in an easterly and northeasterly 
  2.18  direction through the Red Lake wildlife management area to the 
  2.19  east boundary of the Red Lake wildlife management area at the 
  2.20  southwest corner of Section 7, Township 157 North, Range 33 
  2.21  West, Lake of the Woods county; 
  2.22     (2) the Blanchard forest road, beginning at the junction of 
  2.23  the North Shore Road along the northern shore of Upper Red Lake 
  2.24  and the Blanchard state forest road at the west section line of 
  2.25  Section 30, Township 155 North, Range 31 West, Beltrami county, 
  2.26  thence in a westerly direction to the west section line of 
  2.27  Section 31, Township 155 North, Range 32 West; and 
  2.28     (3) the Moose River forest road, beginning at the junction 
  2.29  of Dick's Parkway state forest road and the Moose River state 
  2.30  forest road at the southwest corner of Section 31, Township 36 
  2.31  West, Range 158 North, thence in a westerly direction along the 
  2.32  Moose River state forest road to the junction of Beltrami county 
  2.33  road 706; and 
  2.34     (4) the existing west access road to the Moose River dike, 
  2.35  which is included in meeting the required all-terrain vehicle 
  2.36  trail mileage specified in paragraph (a). 
  3.1      (c) The commissioner shall sign each road and trail 
  3.2   designated under this subdivision indicating the motorized uses 
  3.3   allowed. 
  3.4      (d) During the regular firearms deer season, on all 
  3.5   wildlife management area lands within the area described in 
  3.6   paragraph (e), a person licensed to take deer may operate an 
  3.7   all-terrain vehicle: 
  3.8      (1) before legal shooting hours; 
  3.9      (2) after legal shooting hours; and 
  3.10     (3) from 11:00 a.m. to 2:00 p.m. 
  3.11     (e) Paragraph (d) applies from where state highway No. 1 
  3.12  intersects the west boundary of the Red Lake Indian Reservation, 
  3.13  then West to state highway No. 219, then North on state highway 
  3.14  No. 219 to state highway No. 89, then North on state highway No. 
  3.15  89 to county highway No. 6, then East on county highway No. 6 to 
  3.16  county highway No. 54 and county highway No. 1 
  3.17  (Beltrami/Marshall county line) then North along the 
  3.18  Beltrami/Marshall county line to Roseau county line, then East 
  3.19  on Beltrami/Roseau county line to Dick's Parkway, then South on 
  3.20  Dick's Parkway to county road No. 704, Beltrami county, then 
  3.21  South to county state-aid highway No. 44 to Fourtown, then South 
  3.22  on state highway No. 89 to the North boundary of the Red Lake 
  3.23  Indian Reservation, then West and South following the boundary 
  3.24  of the Red Lake Indian Reservation to where it intersects state 
  3.25  highway No. 1. 
  3.26     (d) (f) For the purposes of this subdivision, "corridors of 
  3.27  disturbance" means rights-of-way such as ditches, ditch banks, 
  3.28  transmission lines, pipelines, permanent roads, winter roads, 
  3.29  and recreational trails.  The existence of a corridor of 
  3.30  disturbance eligible for corridor designation may be 
  3.31  demonstrated by physical evidence, document recorded in the 
  3.32  office of the county recorder or other public official, aerial 
  3.33  survey, or other evidence similar to the above.  Cross-country 
  3.34  motorized use of land shall not cause that land to be considered 
  3.35  a corridor of disturbance. 
  3.36     Sec. 2.  Minnesota Statutes 2001 Supplement, section 
  4.1   297A.94, is amended to read: 
  4.2      297A.94 [DEPOSIT OF REVENUES.] 
  4.3      (a) Except as provided in this section, the commissioner 
  4.4   shall deposit the revenues, including interest and penalties, 
  4.5   derived from the taxes imposed by this chapter in the state 
  4.6   treasury and credit them to the general fund.  
  4.7      (b) The commissioner shall deposit taxes in the Minnesota 
  4.8   agricultural and economic account in the special revenue fund if:
  4.9      (1) the taxes are derived from sales and use of property 
  4.10  and services purchased for the construction and operation of an 
  4.11  agricultural resource project; and 
  4.12     (2) the purchase was made on or after the date on which a 
  4.13  conditional commitment was made for a loan guaranty for the 
  4.14  project under section 41A.04, subdivision 3. 
  4.15  The commissioner of finance shall certify to the commissioner 
  4.16  the date on which the project received the conditional 
  4.17  commitment.  The amount deposited in the loan guaranty account 
  4.18  must be reduced by any refunds and by the costs incurred by the 
  4.19  department of revenue to administer and enforce the assessment 
  4.20  and collection of the taxes.  
  4.21     (c) The commissioner shall deposit the revenues, including 
  4.22  interest and penalties, derived from the taxes imposed on sales 
  4.23  and purchases included in section 297A.61, subdivision 3, 
  4.24  paragraph (g), clauses (1) and (4), in the state treasury, and 
  4.25  credit them as follows: 
  4.26     (1) first to the general obligation special tax bond debt 
  4.27  service account in each fiscal year the amount required by 
  4.28  section 16A.661, subdivision 3, paragraph (b); and 
  4.29     (2) after the requirements of clause (1) have been met, the 
  4.30  balance to the general fund. 
  4.31     (d) The commissioner shall deposit the revenues, including 
  4.32  interest and penalties, collected under section 297A.64, 
  4.33  subdivision 5, in the state treasury and credit them to the 
  4.34  general fund.  By July 15 of each year the commissioner shall 
  4.35  transfer to the highway user tax distribution fund an amount 
  4.36  equal to the excess fees collected under section 297A.64, 
  5.1   subdivision 5, for the previous calendar year. 
  5.2      (e) For fiscal year 2001, 97 percent; for fiscal years 2002 
  5.3   and 2003, 87 percent; and for fiscal year 2004 and 
  5.4   thereafter, 88.5 87.1 percent of the revenues, including 
  5.5   interest and penalties, transmitted to the commissioner under 
  5.6   section 297A.65, must be deposited by the commissioner in the 
  5.7   state treasury as follows: 
  5.8      (1) 50 percent of the receipts must be deposited in the 
  5.9   heritage enhancement account in the game and fish fund, and may 
  5.10  be spent only on activities that improve, enhance, or protect 
  5.11  fish and wildlife resources, including conservation, 
  5.12  restoration, and enhancement of land, water, and other natural 
  5.13  resources of the state; 
  5.14     (2) 22.5 percent of the receipts must be deposited in the 
  5.15  natural resources fund, and may be spent only for state parks 
  5.16  and trails; 
  5.17     (3) 22.5 percent of the receipts must be deposited in the 
  5.18  natural resources fund, and may be spent only on metropolitan 
  5.19  park and trail grants; 
  5.20     (4) three percent of the receipts must be deposited in the 
  5.21  natural resources fund, and may be spent only on local trail 
  5.22  grants; and 
  5.23     (5) two percent of the receipts must be deposited in the 
  5.24  natural resources fund, and may be spent only for the Minnesota 
  5.25  zoological garden, the Como park zoo and conservatory, and the 
  5.26  Duluth zoo. 
  5.27     (f) The revenue dedicated under paragraph (e) may not be 
  5.28  used as a substitute for traditional sources of funding for the 
  5.29  purposes specified, but the dedicated revenue shall supplement 
  5.30  traditional sources of funding for those purposes.  Land 
  5.31  acquired with money deposited in the game and fish fund under 
  5.32  paragraph (e) must be open to public hunting and fishing during 
  5.33  the open season, except that in aquatic management areas or on 
  5.34  lands where angling easements have been acquired, fishing may be 
  5.35  prohibited during certain times of the year and hunting may be 
  5.36  prohibited.  At least 87 percent of the money deposited in the 
  6.1   game and fish fund for improvement, enhancement, or protection 
  6.2   of fish and wildlife resources under paragraph (e) must be 
  6.3   allocated for field operations. 
  6.4      Sec. 3.  Minnesota Statutes 2001 Supplement, section 
  6.5   477A.14, is amended to read: 
  6.6      477A.14 [USE OF FUNDS.] 
  6.7      Subdivision 1.  [GENERAL DISTRIBUTION.] Except as provided 
  6.8   in subdivision 2 or in section 97A.061, subdivision 5, 40 
  6.9   percent of the total payment to the county shall be deposited in 
  6.10  the county general revenue fund to be used to provide property 
  6.11  tax levy reduction.  The remainder shall be distributed by the 
  6.12  county in the following priority:  
  6.13     (a) 37.5 cents, as adjusted for inflation under section 
  6.14  477A.145, for each acre of county-administered other natural 
  6.15  resources land shall be deposited in a resource development fund 
  6.16  to be created within the county treasury for use in resource 
  6.17  development, forest management, game and fish habitat 
  6.18  improvement, and recreational development and maintenance of 
  6.19  county-administered other natural resources land.  Any county 
  6.20  receiving less than $5,000 annually for the resource development 
  6.21  fund may elect to deposit that amount in the county general 
  6.22  revenue fund; 
  6.23     (b) From the funds remaining, within 30 days of receipt of 
  6.24  the payment to the county, the county treasurer shall pay each 
  6.25  organized township 30 cents, as adjusted for inflation under 
  6.26  section 477A.145, for each acre of acquired natural resources 
  6.27  land and each acre of land described in section 477A.12, 
  6.28  subdivision 1, paragraph (b), and 7.5 cents, as adjusted for 
  6.29  inflation under section 477A.145, for each acre of other natural 
  6.30  resources land located within its boundaries.  Payments for 
  6.31  natural resources lands not located in an organized township 
  6.32  shall be deposited in the county general revenue fund.  Payments 
  6.33  to counties and townships pursuant to this paragraph shall be 
  6.34  used to provide property tax levy reduction, except that of the 
  6.35  payments for natural resources lands not located in an organized 
  6.36  township, the county may allocate the amount determined to be 
  7.1   necessary for maintenance of roads in unorganized townships.  
  7.2   Provided that, if the total payment to the county pursuant to 
  7.3   section 477A.12 is not sufficient to fully fund the distribution 
  7.4   provided for in this clause, the amount available shall be 
  7.5   distributed to each township and the county general revenue fund 
  7.6   on a pro rata basis; and 
  7.7      (c) Any remaining funds shall be deposited in the county 
  7.8   general revenue fund.  Provided that, if the distribution to the 
  7.9   county general revenue fund exceeds $35,000, the excess shall be 
  7.10  used to provide property tax levy reduction. 
  7.11     Subd. 2.  [DISTRIBUTION FOR CONSOLIDATED CONSERVATION 
  7.12  LANDS.] In the case of payments for consolidated conservation 
  7.13  land, at least 15 percent of the amount paid on account of that 
  7.14  land under section 477A.12 must be distributed to the county for 
  7.15  use as provided in section 84A.51, subdivision 4, clause (1).  
  7.16  The remainder of the payment under section 477A.12 will be 
  7.17  distributed in proportion to the distributions described in 
  7.18  subdivision 1. 
  7.19     Sec. 4.  [ADDITIONS TO STATE WILDLIFE MANAGEMENT AREAS 
  7.20  INCLUDED IN 1991 COMMISSIONER'S ORDERS.] 
  7.21     Subdivision 1.  [97A.133] [Subd. 6.] [BEAR CREEK WILDLIFE 
  7.22  MANAGEMENT AREA; ROSEAU COUNTY.] The following areas are added 
  7.23  to Bear Creek wildlife management area:  the SE1/4-SE1/4 of 
  7.24  Section 27; NE1/4 and E1/2-SE1/4 of Section 34; all in Township

 18.23     Sec. 5.  [EXCHANGE PARCELS.] 
 18.24     Subdivision 1.  [LAND EXCHANGE.] If a land exchange is 
 18.25  offered to the state that, after evaluation by the department of 
 18.26  natural resources, is determined to meet the state's natural 
 18.27  resource goals and meet all other land exchange requirements 
 18.28  under existing law, the parcels in subdivisions 2 and 3 shall be 
 18.29  exchanged.

 18.36  north of county ditch of Section 10, Township 162 North, Range 
 19.1   37 West. 
 19.2      (b) East Branch wildlife management area:  NW1/4-NE1/4 of 
 19.3   Section 21, Township 162 North, Range 36 West; and SE1/4-NE1/4 
 19.4   of Section 28, Township 162 North, Range 36 West. 
 19.5      Sec. 6.  [PUBLIC OR PRIVATE CONVEYANCE OF CONSOLIDATED 
 19.6   CONSERVATION LAND; ROSEAU COUNTY.] 
 19.7      (a) Notwithstanding the classification and public sale 
 19.8   provisions of Minnesota Statutes, chapters 84A and 282, or other 
 19.9   law to the contrary, Roseau county may sell, either by public 
 19.10  sale or private sale, the consolidated conservation land that is 
 19.11  described in paragraph (d) under the remaining provisions of 
 19.12  Minnesota Statutes, chapters 84A and 282. 
 19.13     (b) The land described in paragraph (d) may be sold without 
 19.14  the public hearing required under Minnesota Statutes, section 
 19.15  97A.135, subdivision 2a, with the wildlife management area 
 19.16  designation deemed vacated upon the sale of the land. 
 19.17     (c) The conveyance must be in a form approved by the 
 19.18  attorney general and for not less than the appraised value of 
 19.19  the land.  Proceeds shall be disposed of according to Minnesota 
 19.20  Statutes, chapter 84A. 
 19.21     (d) The land that may be sold is located in Roseau county 
 19.22  and is described as:  the south ten acres of the SE1/4-NW1/4 of 
 19.23  Section 34, Township 159 North, Range 39 West. 
 19.24     Sec. 7.  [ALL-TERRAIN VEHICLE VIOLATIONS ON LANDS 
 19.25  DESIGNATED.] 
 19.26     Until January 15, 2004, on lands designated as wildlife 
 19.27  management areas under this act, the commissioner may issue 
 19.28  citations for all-terrain vehicle use violations only as 
 19.29  provided by the following: 
 19.30     (1) a person observed unloading an all-terrain vehicle with 
 19.31  an apparent intent to enter the wildlife management area, shall 
 19.32  be verbally warned by the officer; 
 19.33     (2) a person observed improperly operating an all-terrain 
 19.34  vehicle in the wildlife management area shall be stopped, issued 
 19.35  a written warning, and directed to leave, or escorted out of, 
 19.36  the wildlife management area, if this is the person's first 
 20.1   offense; 
 20.2      (3) a person who has received prior warnings, either 
 20.3   written or verbal, from an enforcement officer, directly 
 20.4   relating to all-terrain vehicle operation in wildlife management 
 20.5   areas, and who is observed illegally operating an all-terrain 
 20.6   vehicle in the wildlife management area may be issued a 
 20.7   citation; and 
 20.8      (4) a person who is operating an all-terrain vehicle in a 
 20.9   wildlife management area and who is intentionally creating 
 20.10  serious damage to the wildlife management area, or who is 
 20.11  involved in some other violations of law, will be issued 
 20.12  appropriate citations or arrested. 
 20.13     Sec. 8.  [WILDLIFE MANAGEMENT AREA ACCESS WORKING GROUPS; 
 20.14  BELTRAMI, MARSHALL, AND ROSEAU COUNTIES; COMMISSIONER'S REPORT.] 
 20.15     (a) The commissioner of natural resources shall establish 
 20.16  an eight-member wildlife management area access working group 
 20.17  for each county with land designated under this act to identify 
 20.18  trails for designation under Minnesota Statutes, section 
 20.19  97A.133, subdivision 3, paragraph (a).  Each working group shall 
 20.20  consist of two county board representatives chosen by the county 
 20.21  board, two staff members from the department of natural 
 20.22  resources who are assigned to the region and chosen by the 
 20.23  commissioner, two representatives of local all-terrain vehicle 
 20.24  users chosen by the county board, and two representatives of 
 20.25  nonmotorized wildlife management area users chosen by the 
 20.26  commissioner.  A working group may consider and forward 
 20.27  recommendations to the commissioner on other access issues on 
 20.28  wildlife management areas, designated under Minnesota Statutes, 
 20.29  section 97A.133, subdivision 3, paragraph (a).  Each working 
 20.30  group must: 
 20.31     (1) meet as necessary to identify potential all-terrain 
 20.32  vehicle trail routes on wildlife management areas within the 
 20.33  county; 
 20.34     (2) vote on recommendations for proposed trail 
 20.35  designations; and 
 20.36     (3) report to the commissioner on the vote for each trail 
 21.1   proposed. 
 21.2      (b) By January 15, in 2003 and 2004, the commissioner shall 
 21.3   report to the senate and house of representatives policy and 
 21.4   finance committees with jurisdiction over natural resources on 
 21.5   the progress in identifying and designating trails, under 
 21.6   Minnesota Statutes, section 97A.133, subdivision 3.  The report 
 21.7   shall include a status report on: 
 21.8      (1) progress toward meeting the required trail mileage in 
 21.9   Minnesota Statutes, section 97A.133, subdivision 3, paragraph 
 21.10  (a); and 
 21.11     (2) an update of the activities of each of the working 
 21.12  groups established in paragraph (a), including a description of 
 21.13  all trail proposals that either passed by a majority vote of the 
 21.14  group or failed on a tie vote. 
 21.15     Sec. 9.  [EFFECTIVE DATE.] 
 21.16     Sections 1, 2, and 4 to 8 are effective January 1, 2003, 
 21.17  and for the purposes of the payments in lieu of taxes under 
 21.18  Minnesota Statutes, sections 477A.11 to 477A.145, the land 
 21.19  status changes are effective for payments made in calendar year 
 21.20  2003 and thereafter.  Section 3 is effective the day following 
 21.21  final enactment and is effective for payments made in 2002 and 
 21.22  thereafter.
