  1.1                          A bill for an act 
  1.2             relating to crime prevention; providing for lifetime 
  1.3             probation for certain repeat offenders; amending 
  1.4             Minnesota Statutes 2002, section 609.1095, by adding a 
  1.5             subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 609.1095, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 3a.  [LIFETIME PROBATION FOR CERTAIN DANGEROUS REPEAT 
  1.10  OFFENDERS.] (a) Notwithstanding the statutory maximum sentence 
  1.11  otherwise applicable to the offense or any provision of the 
  1.12  sentencing guidelines or section 609.135, when a court sentences 
  1.13  a person under subdivision 3, in addition to the sentence 
  1.14  required in that subdivision, the court shall sentence the 
  1.15  person to lifetime probation. 
  1.16     (b) The court shall have continuing jurisdiction over 
  1.17  persons sentenced to lifetime probation under paragraph (a), 
  1.18  beginning after the completion of any supervised release term 
  1.19  under section 244.05.  Upon each violation of a term of 
  1.20  probation, the court may order an appropriate sanction, 
  1.21  including, but not limited to, incarcerating the person for a 
  1.22  period specified by the court in a local jail or workhouse, or 
  1.23  prison. 
  1.24     (c) Notwithstanding paragraph (a), the court may only 
  1.25  sentence the person to lifetime probation if the person is 
  2.1   convicted of a violent crime that is a felony and the court 
  2.2   determines on the record at the time of sentencing that the 
  2.3   person has two or more prior felony convictions for violent 
  2.4   crimes. 
  2.5      Sec. 2.  [EFFECTIVE DATE.] 
  2.6      Section 1 is effective August 1, 2003, and applies to 
  2.7   crimes committed on or after that date.
