  1.1                          A bill for an act 
  1.2             relating to human services; expanding the exemption 
  1.3             from medical assistance co-payments; appropriating 
  1.4             money; amending Minnesota Statutes 2003 Supplement, 
  1.5             section 256B.0631, subdivision 2. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2003 Supplement, section 
  1.8   256B.0631, subdivision 2, is amended to read: 
  1.9      Subd. 2.  [EXCEPTIONS.] Co-payments shall be subject to the 
  1.10  following exceptions: 
  1.11     (1) children under the age of 21; 
  1.12     (2) pregnant women for services that relate to the 
  1.13  pregnancy or any other medical condition that may complicate the 
  1.14  pregnancy; 
  1.15     (3) recipients expected to reside for at least 30 days in a 
  1.16  hospital, nursing home, corporate adult foster care home also 
  1.17  registered as a housing with services establishment, or 
  1.18  intermediate care facility for the mentally retarded; 
  1.19     (4) recipients receiving hospice care; 
  1.20     (5) 100 percent federally funded services provided by an 
  1.21  Indian health service; 
  1.22     (6) emergency services; 
  1.23     (7) family planning services; 
  1.24     (8) services that are paid by Medicare, resulting in the 
  1.25  medical assistance program paying for the coinsurance and 
  2.1   deductible; and 
  2.2      (9) co-payments that exceed one per day per provider for 
  2.3   nonpreventive visits, eyeglasses, and nonemergency visits to a 
  2.4   hospital-based emergency room. 
  2.5      Sec. 2.  [APPROPRIATION.] 
  2.6      $....... is appropriated from the general fund to the 
  2.7   commissioner of human services for the fiscal year beginning 
  2.8   July 1, 2004, for the purposes of section 1.
