1.1 A bill for an act 1.2 relating to claims against the state; providing for 1.3 settlement of various claims; appropriating money. 1.4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.5 Section 1. [DEPARTMENT OF CORRECTIONS.] 1.6 The amounts in this section are appropriated from the 1.7 general fund to the commissioner of corrections in fiscal year 1.8 2005 as full and final payment under Minnesota Statutes, section 1.9 3.739, of claims against the state for injuries suffered by and 1.10 medical services provided to persons injured while performing 1.11 community service or sentence-to-service work for correctional 1.12 purposes or while incarcerated in a correctional facility. 1.13 (a) For claims already paid by the department, $1,304.84. 1.14 (b) For payment to William Brown for a permanent partial 1.15 disability suffered while performing community service work in 1.16 Carlton County, $35,090. 1.17 (c) For payment to Jaamal Ali, for a permanent partial 1.18 disability suffered while performing sentence-to-service work in 1.19 Olmsted County, $850; and for medical services provided to 1.20 Jaamal Ali, $2,974.35. 1.21 (d) For payment to D. W., a juvenile, for a permanent 1.22 partial disability suffered while performing community service 1.23 work in Stearns County, $5,800. 1.24 (e) For payment to Jim Gibson, for a permanent partial 2.1 disability suffered while performing duties at the Minnesota 2.2 Correctional Facility - Lino Lakes, $3,187.50. 2.3 (f) For payment to Michael Harper, for a permanent partial 2.4 disability suffered while performing sentence-to-service work in 2.5 Washington County, $750; and for medical services provided to 2.6 Michael Harper, $1,061.25. 2.7 (g) For payment to Jeffie King, for a permanent partial 2.8 disability suffered while performing duties at the Minnesota 2.9 Correctional Facility - Stillwater, $9,350. 2.10 (h) For payment to Joe Rodriguez, for a permanent partial 2.11 disability suffered while performing duties at the Minnesota 2.12 Correctional Facility - Moose Lake, $247.50. 2.13 (i) For payment to Steven Rosoff for a permanent partial 2.14 disability suffered while performing sentence-to-service work in 2.15 Hennepin County, $7,200. 2.16 Sec. 2. [DEPARTMENT OF NATURAL RESOURCES.] 2.17 Subdivision 1. [BODE CLAIM.] (a) $27,000 is appropriated 2.18 from the general fund to the commissioner of natural resources 2.19 in fiscal year 2005 for payment to Linda and Judy Bode of 2.20 Nicollet, Minnesota, for expenses incurred during the pendency 2.21 of appeal of the public waters hearing panel decision as a full 2.22 and final settlement of their claim against the state. 2.23 (b) The Office of Administrative Hearings shall assign an 2.24 administrative law judge to determine, after a hearing, whether 2.25 that portion of the area designated as Wetland 52-26 by the 2.26 Department of Natural Resources that is located on the Bode farm 2.27 is a public waters wetland. In making that determination, the 2.28 administrative law judge must use the definition of "wetlands" 2.29 in Minnesota Statutes 1980, section 105.37, subdivision 15. The 2.30 determination of the administrative law judge is final. 2.31 Subd. 2. [PETTY CLAIM.] $38,118.57 is appropriated from 2.32 the general fund to the commissioner of natural resources in 2.33 fiscal year 2005 for payment to Petty and Sons Timber Products, 2.34 Inc. of Wahkon, Minnesota, as a full and final settlement of its 2.35 claim against the state for losses suffered because of a 2.36 moratorium imposed on raising logs from Minnesota lake bottoms. 3.1 Subd. 3. [SHOEN CLAIM.] $1,353.26 is appropriated from the 3.2 general fund to the commissioner of natural resources in fiscal 3.3 year 2005 for payment to Samuel and June Shoen of Angle Inlet, 3.4 Minnesota, as a full and final settlement of their claim against 3.5 the state for reimbursement of trespass fines paid during 3.6 settlement of a land exchange.
