  1.1                          A bill for an act
  1.2             relating to the human rights act; providing that 
  1.3             making certain equal opportunities in athletic 
  1.4             programs available on the basis of sex is not an 
  1.5             unfair discriminatory practice; amending Minnesota 
  1.6             Statutes 1994, section 363.02, subdivision 4. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1994, section 363.02, 
  1.9   subdivision 4, is amended to read: 
  1.10     Subd. 4.  [PUBLIC ACCOMMODATIONS.] The provisions of 
  1.11  section 363.03, subdivision 3, relating to sex, shall not apply 
  1.12  to such facilities as restrooms, locker rooms, and other similar 
  1.13  places.  The provisions of section 363.03, subdivision 3, do not 
  1.14  apply to employees or volunteers of a nonpublic service 
  1.15  organization whose primary function is providing occasional 
  1.16  services to minors, such as youth sports organizations, scouting 
  1.17  organizations, boys' or girls' clubs, programs providing 
  1.18  friends, counselors, or role models for minors, youth theater, 
  1.19  dance, music or artistic organizations, agricultural 
  1.20  organizations for minors, and other youth organizations, with 
  1.21  respect to qualifications based on sexual orientation. 
  1.22     The provisions of section 363.03, subdivision 3, relating 
  1.23  to sex, do not apply to restricting membership on an athletic 
  1.24  team or in a program or event to participants of one sex whose 
  1.25  overall athletic opportunities have previously been limited.  If 
  1.26  two teams, programs, or events are provided in the same sport, 
  2.1   one team, program, or event may be restricted to members of a 
  2.2   sex whose overall athletic opportunities have previously been 
  2.3   limited, and members of either sex shall be permitted to try out 
  2.4   for the other team, program, or event.
