  1.1                          A bill for an act 
  1.2             relating to education; modifying AIDS prevention 
  1.3             program to include human papilloma virus prevention; 
  1.4             amending Minnesota Statutes 1998, section 121A.23. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1998, section 121A.23, is 
  1.7   amended to read: 
  1.8      121A.23 [HEALTH-RELATED PROGRAMS.] 
  1.9      Subdivision 1.  [AIDS AND HPV PROGRAM.] The commissioner of 
  1.10  children, families, and learning, in consultation with the 
  1.11  commissioner of health, shall assist districts in developing and 
  1.12  implementing a program to prevent and reduce the risk of 
  1.13  acquired immune deficiency syndrome (AIDS) and human papilloma 
  1.14  virus (HPV).  Each district must have a program that includes at 
  1.15  least: 
  1.16     (1) planning materials, guidelines, and other technically 
  1.17  accurate and updated information; 
  1.18     (2) a comprehensive, technically accurate, and updated 
  1.19  curriculum that encourages schools to help students abstain from 
  1.20  sexual activity until marriage; 
  1.21     (3) cooperation and coordination among districts and SCs; 
  1.22     (4) a targeting of adolescents, especially those who may be 
  1.23  at high risk of contracting AIDS and HPV, for prevention 
  1.24  efforts; 
  1.25     (5) involvement of parents and other community members; 
  2.1      (6) in-service training for appropriate district staff and 
  2.2   school board members; 
  2.3      (7) collaboration with state agencies and organizations 
  2.4   having an AIDS or HPV prevention or AIDS or HPV risk reduction 
  2.5   program; 
  2.6      (8) collaboration with local community health services, 
  2.7   agencies and organizations having an AIDS or HPV prevention or 
  2.8   AIDS or HPV risk reduction program; and 
  2.9      (9) participation by state and local student organizations. 
  2.10     The department may provide assistance at a neutral site to 
  2.11  a nonpublic school participating in a district's program.  
  2.12  District programs must not conflict with the health and wellness 
  2.13  curriculum developed under Laws 1987, chapter 398, article 5, 
  2.14  section 2, subdivision 7. 
  2.15     If a district fails to develop and implement a program to 
  2.16  prevent and reduce the risk of AIDS or HPV, the department must 
  2.17  assist the service cooperative in the region serving that 
  2.18  district to develop or implement the program.  A district 
  2.19  sponsored community education program may fulfill this statute. 
  2.20     Subd. 2.  [FUNDING SOURCES.] Districts may accept funds for 
  2.21  AIDS or HPV programs developed and implemented under this 
  2.22  section from public and private sources including public health 
  2.23  funds and foundations, department professional development 
  2.24  funds, federal block grants or other federal or state grants.
