A bill for an act
relating to medical practice; modifying orders for discipline; amending
Minnesota Statutes 2006, section 147.091, subdivision 3.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 147.091, subdivision 3, is amended to read:


Subd. 3.

Conditions on reissued license.

new text begin (a) new text end In its discretion, the board may restore
and reissue a license to practice medicine, but as a condition thereof may impose any
disciplinary or corrective measure which it might originally have imposed.

new text begin (b) Except as provided in paragraph (d), when a licensee has satisfied any
disciplinary or corrective measures imposed by the board under paragraph (a), the board
shall vacate any related order for discipline, which shall become void and of no effect. The
order restoring or reissuing an unconditional license or removing conditions or limitations
on the license may detail the facts upon which the license was suspended, limited, or
otherwise conditioned and the corrective action the licensee was required to take, but it
shall make no other reference to the voided order for discipline.

new text begin (c) Upon the written request of the licensee following an order for unconditional
license or other order removing any conditions or limitations on the license, the board
shall notify any person, organization, or other entity that received the original order for
discipline that the order is void and of no effect.

new text begin (d) The provisions of paragraphs (b) and (c) shall not apply to any orders for
discipline based on fraudulent, intentional or deliberate misconduct, sexual misconduct,
or conviction of a felony.

new text begin This section is effective the day following final enactment, and applies to all past,
current, and future orders for discipline entered by the board.
