  1.1                          A bill for an act 
  1.2             relating to capital improvements; public safety; 
  1.3             authorizing issuance of bonds for the initial phase of 
  1.4             the metropolitan regionwide public safety radio 
  1.5             communications system; appropriating money; amending 
  1.6             Minnesota Statutes 1995 Supplement, section 473.901, 
  1.7             subdivision 1. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1995 Supplement, section 
  1.10  473.901, subdivision 1, is amended to read: 
  1.11     Subdivision 1.  [COSTS COVERED BY FEE.] Beginning July 1, 
  1.12  1995, the amount necessary to pay the following costs shall be 
  1.13  paid from money is appropriated to the commissioner of 
  1.14  administration for those costs from the 911 emergency telephone 
  1.15  service account established under section 403.11: 
  1.16     (1) debt service costs and reserves for bonds issued 
  1.17  pursuant to section 473.898; 
  1.18     (2) repayment of the right-of-way acquisition loans; 
  1.19     (3) costs of design, construction, maintenance of, and 
  1.20  improvements to those elements of the first phase that support 
  1.21  mutual aid communications and emergency medical services; or 
  1.22     (4) recurring charges for leased sites and equipment for 
  1.23  those elements of the first phase that support actual aid and 
  1.24  emergency medical communication services. 
  1.25     Money appropriated from the 911 emergency telephone service 
  1.26  fee account This appropriation shall be used to pay annual debt 
  2.1   service costs and reserves for bonds issued pursuant to section 
  2.2   473.898 prior to use of fee money to pay other costs eligible 
  2.3   under this subdivision.  In no event shall the money 
  2.4   appropriated from the 911 emergency telephone service fee 
  2.5   account for the first phase radio system this appropriation 
  2.6   exceed an amount equal to four cents a month for each customer 
  2.7   access line or other basic access service, including trunk 
  2.8   equivalents as designated by the public utilities commission for 
  2.9   access charge purposes and including cellular and other nonwire 
  2.10  access services. 
  2.11     Sec. 2.  [APPROPRIATION; BONDING AUTHORIZATION.] 
  2.12     Subdivision 1.  [APPROPRIATION.] $15,000,000 is 
  2.13  appropriated from the bond proceeds fund to the commissioner of 
  2.14  transportation to construct the initial backbone of the 
  2.15  metropolitan regionwide public safety radio communications 
  2.16  system described in Laws 1995, chapter 195. 
  2.17     Subd. 2.  [BONDING AUTHORIZATION.] To provide the money 
  2.18  appropriated in this section from the bond proceeds fund, the 
  2.19  commissioner of finance, on request of the governor, shall sell 
  2.20  and issue bonds in an amount up to $15,000,000 in the manner, 
  2.21  upon the terms, and with the effect prescribed in Minnesota 
  2.22  Statutes, sections 16A.631 to 16A.675, and by the Minnesota 
  2.23  Constitution, article XI, sections 4 to 7. 
  2.24     Sec. 3.  [EFFECTIVE DATE.] 
  2.25     This act is effective the day following final enactment.
