  1.1                          A bill for an act 
  1.2             relating to education; modifying instruction areas for 
  1.3             assurance of mastery programs; amending Minnesota 
  1.4             Statutes 1994, section 124.311, subdivisions 1 and 4. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1994, section 124.311, 
  1.7   subdivision 1, is amended to read: 
  1.8      Subdivision 1.  [INSTRUCTION IN REGULAR CLASSROOM.] A 
  1.9   school district may receive assurance of mastery revenue to 
  1.10  provide direct instructional services to eligible pupils in the 
  1.11  pupils' regular classroom or in a designated assurance of 
  1.12  mastery area.  
  1.13     Sec. 2.  Minnesota Statutes 1994, section 124.311, 
  1.14  subdivision 4, is amended to read: 
  1.15     Subd. 4.  [ELIGIBLE SERVICES.] Assurance of mastery revenue 
  1.16  must be used to provide direct instructional services to an 
  1.17  eligible pupil, or group of eligible pupils, under the following 
  1.18  conditions:  
  1.19     (a) Instruction may be provided at one or more grade levels 
  1.20  from kindergarten through grade 8.  If an assessment of pupils' 
  1.21  needs within a district demonstrates that the eligible pupils in 
  1.22  grades kindergarten through 8 are being appropriately served, a 
  1.23  district may serve eligible pupils in grades 9 through 12. 
  1.24     (b) Instruction must be provided in the usual and customary 
  1.25  classroom of the eligible pupil or in a designated assurance of 
  2.1   mastery area.  
  2.2      (c) Instruction must be provided under the supervision of 
  2.3   the eligible pupil's regular classroom teacher.  Instruction may 
  2.4   be provided by the eligible pupil's classroom teacher, by 
  2.5   another teacher, by a team of teachers, or by an education 
  2.6   assistant or aide.  A special education teacher may provide 
  2.7   instruction, but instruction that is provided under this section 
  2.8   is not eligible for aid under section 124.32.  
  2.9      (d) The instruction that is provided must differ from the 
  2.10  initial instruction the pupil received in the regular classroom 
  2.11  setting.  The instruction may differ by presenting different 
  2.12  curriculum than was initially presented in the regular 
  2.13  classroom, or by presenting the same curriculum:  
  2.14     (1) at a different rate or in a different sequence than it 
  2.15  was initially presented; 
  2.16     (2) using different teaching methods or techniques than 
  2.17  were used initially; or 
  2.18     (3) using different instructional materials than were used 
  2.19  initially.
