  1.1                          A bill for an act 
  1.2             relating to medical assistance; eliminating prepaid 
  1.3             medical assistance for nursing home services and 
  1.4             elderly waiver services; amending Minnesota Statutes 
  1.5             1998, section 256B.69, subdivision 6a; repealing 
  1.6             Minnesota Statutes 1998, section 256B.69, subdivision 
  1.7             6b. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1998, section 256B.69, 
  1.10  subdivision 6a, is amended to read: 
  1.11     Subd. 6a.  [NURSING HOME SERVICES.] (a) Notwithstanding 
  1.12  Minnesota Rules, part 9500.1457, subpart 1, item B, nursing 
  1.13  facility services as defined in section 256B.0625, subdivision 
  1.14  2, which are provided in a nursing facility certified by the 
  1.15  Minnesota department of health for services provided and 
  1.16  eligible for payment under Medicaid, shall be covered under the 
  1.17  prepaid medical assistance program for individuals who are not 
  1.18  residing in a nursing facility at the time of enrollment in the 
  1.19  prepaid medical assistance program.  Liability for coverage of 
  1.20  nursing facility services by a participating health plan is 
  1.21  limited to 365 days for any person enrolled under the prepaid 
  1.22  medical assistance program. 
  1.23     (b) For individuals enrolled in the Minnesota senior health 
  1.24  options project authorized under subdivision 23, nursing 
  1.25  facility services shall be covered according to the terms and 
  1.26  conditions of the federal waiver governing that demonstration 
  2.1   project. 
  2.2      Sec. 2.  [REPEALER.] 
  2.3      Minnesota Statutes 1998, section 256B.69, subdivision 6b, 
  2.4   is repealed.
