A bill for an act
relating to health information technology; creating certain requirements for the
use of federal funding; requiring legislative approval of a plan; limiting the
appropriation of federal funds.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin HEALTH INFORMATION TECHNOLOGY INCENTIVES.

new text begin None of the funding available to the state as a result of the American Recovery
and Reinvestment Act of 2009, Division B, Title IV, Section 4001, which specifically
provides funds related to information technology infrastructure or Medicaid incentives
that encourage doctors, hospitals, and other providers to use health information
technology, shall be appropriated or expended prior to the presentation to and approval
by the legislature of a plan incorporating this funding into the existing electronic health
record system revolving account and loan program described in Minnesota Statutes,
section 62J.496. Any plan for the use of federal funding available under this section shall
prioritize rural health clinics and local public health agencies.
