A bill for an act
relating to human rights; creating an exemption for women's athletics in the Human
Rights Act; proposing coding for new law in Minnesota Statutes, chapter 363A.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) Notwithstanding any other provisions of law, it is not unlawful or discriminatory for
any entity, including but not limited to a not-for-profit entity; business as defined in section
363A.03, subdivision 4; organization; educational institution as defined in section 363A.03,
subdivision 14; postsecondary state colleges and universities; nonpublic schools; religious
organization or denominational educational institution; or youth sports organization, to limit
participation in athletic teams and sports competitions to females, women, or girls only.
Limitations may include the exclusion of an individual who is male irrespective of any
individual's gender identity, including trans-identifying athletes whose biological sex is
inconsistent with the individual's gender identity.

(b) For purpose of this section, sex shall be based solely on a person's reproductive
biology, including sex chromosomes and genetics at birth, and is not a synonym for and
does not include the concept of gender identity as defined in section 363A.03, subdivision
50.

(c) Nothing in this section shall be construed to prohibit a female athletic team from
permitting males to train or practice with an athletic program or activity that is designed
for women or girls so long as females are not deprived of any opportunity, including but
not limited to a roster spot on the team whether in competition or in practice.

(d) No governmental agency, licensing, or accrediting organization, or athletic association
or organization, shall entertain a complaint, open an investigation, or take any adverse action
pursuant to this chapter against an entity adopting a policy or rules for athletic competitions
that are only for females consistent with the exemption allowed in this section.

This section is effective the day following final enactment.
