  1.1                          A bill for an act 
  1.2             relating to construction activities; requiring notice 
  1.3             of certain proposed animal feedlots and residential 
  1.4             developments; amending Minnesota Statutes 1996, 
  1.5             section 116.07, by adding a subdivision; proposing 
  1.6             coding for new law in Minnesota Statutes, chapter 394. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1996, section 116.07, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 7a.  [NOTICE OF APPLICATION FOR LIVESTOCK FEEDLOT 
  1.11  PERMITS.] If the pollution control agency or a county board 
  1.12  receives an application for a permit for a livestock feedlot 
  1.13  with an intended capacity of 1,000 animal units or more, the 
  1.14  agency or board shall notify each owner of real property within 
  1.15  four miles of the proposed livestock feedlot.  The notice must 
  1.16  specify the proposed size, location, and owner or manager of the 
  1.17  livestock feedlot and must be made within 21 days of receipt of 
  1.18  the application. 
  1.19     Sec. 2.  [394.305] [NOTICE OF RESIDENTIAL DEVELOPMENT OF 
  1.20  AGRICULTURAL LAND.] 
  1.21     If a county that has a comprehensive land use or zoning 
  1.22  plan receives an application for a permit for a residential 
  1.23  development of 12 or more units on land that has been used for 
  1.24  agricultural purposes, the county board shall notify each owner 
  1.25  of real property within four miles of the proposed residential 
  1.26  development.  The notice must specify the proposed size, 
  2.1   location, and owner or developer of the residential development 
  2.2   and must be made within 21 days of receipt of the application. 
  2.3      Sec. 3.  [394.306] [ATTORNEY GENERAL'S ASSISTANCE.] 
  2.4      On request of a county board, the attorney general shall 
  2.5   assist the county in making the notifications required in 
  2.6   sections 116.07, subdivision 7a, and 394.305.
