  1.1                          A bill for an act 
  1.2             relating to public safety; requiring commissioner of 
  1.3             public safety to adopt rules for fire-resistant 
  1.4             standards for cigarettes and authorizing expedited 
  1.5             process to adopt those rules; proposing coding for new 
  1.6             law in Minnesota Statutes, chapter 299F.  
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [299F.90] [CIGARETTE FIRE SAFETY; RULES 
  1.9   REQUIRED.] 
  1.10     The commissioner of public safety, with the assistance of 
  1.11  the state fire marshal, shall adopt rules containing 
  1.12  fire-resistant cigarette standards.  The rules must be 
  1.13  substantively identical to the New York state rules on the 
  1.14  subject, including the provision allowing dealers to use up 
  1.15  their existing inventory.  The commissioner may use the 
  1.16  expedited process in section 14.389 to adopt the rules.  The 
  1.17  rules must be adopted and in effect by January 1, 2005, or six 
  1.18  months after the New York state rules go into effect, whichever 
  1.19  is later.  
  1.20     [EFFECTIVE DATE.] This section is effective the day 
  1.21  following final enactment.
