1.1 A bill for an act 1.2 relating to drivers' licenses; requiring certain 1.3 applicants for license renewal to pass examinations; 1.4 making clarifying changes; amending Minnesota Statutes 1.5 2002, section 171.13, subdivision 2. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 2002, section 171.13, 1.8 subdivision 2, is amended to read: 1.9 Subd. 2. [EXAMINATION UPON RENEWAL.] The department shall 1.10 issue a driver's license upon renewal when: 1.11 (1) the applicant has passed an examination consisting of a 1.12 screening of the applicant's eyesight. Screening of eyesight 1.13 required by this subdivision does not constitute the practice of 1.14 optometry as defined in section 148.56; 1.15 (2) an applicant who, since the last previous license 1.16 renewal or issuance, received a warning letter or attended a 1.17 preliminary hearing as a habitual violator, within the meaning 1.18 of Minnesota Rules, has passed a written examination; and 1.19 (3) an applicant who, since the last previous license 1.20 renewal or issuance, was at fault in two or more crashes or had 1.21 driving privileges suspended as a habitual violator, has passed 1.22 a road examination. 1.23 The commissioner may adopt rules to administer this subdivision. 1.24 Sec. 2. [EFFECTIVE DATE.] 1.25 Section 1 is effective August 1, 2005.
